On Thursday, February 5, 2009 at 10:00 a.m. EST, this Board will convene a conference call with the parties to discuss matters relating to case scheduling and management.1 The parties should be prepared to discuss the preparation of a scheduling order that is consistent with the model milestones for Subpart L hearings provided in 10 C.F.R. Part 2, Appendix B (II).

In particular, the Board will solicit the parties views on the following topics: (1) the status of the mandatory disclosure process;2 (2) the effect of NRC Staffs projected schedule for completing its safety and environmental evaluations on the scheduling order;3 (3) what plans, if any, the parties have for the filing of preliminary motions or other pleadings; (4) what plans, if any, the parties have for the filing of motions for summary disposition on the currently-admitted 1

contentions; (5) whether the parties are aware of any other matters that may impact the scheduling order; (6) the parties current views on the selection of a venue for the hearing(s);

and (7) any other matters that counsel may wish to bring to the Boards attention. The Board is especially interested in determining whether settlement is feasible and whether Alternative Dispute Resolution efforts should be pursued.4 The Board anticipates that the conference call can be conducted in 60 minutes or less.

No later than 5:00 p.m. EST on Monday, February 2, 2009, counsel should notify Sara Culler - who is a member of the Licensing Board Panels administrative staff, and who may be reached at 301-415-5694 - of their ability to participate in the call at the scheduled time. Ms.

Culler will provide instructions for participating in the call, including the telephone number and pass code. When contacting Ms. Culler, please advise her as to the number of separate locations from which you and any colleagues or associates will be calling, so that she may reserve an appropriate number of phone lines. To assure that the conference call commences promptly, all participants should access the telephone number a few minutes before the conference is scheduled to begin.

The conference call will be stenographically transcribed. After the call, the Board will issue an appropriate Scheduling and Case Management Order.
