ME2946 AND ME2947)

Dear Mr. Nazar:

By letter dated October 16, 2009, Florida Power & Light Company (FPL) requested an exemption to permit St. Lucie, Units 1 and 2 to not meet the Title10 of the Code of Federal Regulations (CFR), Sections 26.205(c) and 26.205(d) work hour control requirements when defined conditions (tropical storm force winds and other conditions) are present prior to the declaration of a plant emergency.

The request would have the effect of extending the applicability of the existing exemption from declared plant emergencies, 10 CFR 26.207(d).

The U.S. Nuclear Regulatory Commission staff has reviewed your submittal and finds that the additional information contained in the enclosed Request for Additional Information is needed before we can complete the review. This was discussed with members of the FPL staff and, on February 4, 2010, Mr. Ken Frehafer indicated that a response would be provided within 3 weeks of the date of this letter. To complete its review of the exemption request, the Nuclear Regulatory Commission staff requests the following additional information. The exemption requests states that, "Specifically, the letter requests exemption from certain specified requirements of Part 26 during preparations for severe weather conditions." Please indicate if the request is to include any period of time during the recovery phase, after the storm has passed. The supporting justification to the St. Lucie exemption request states that, "The hurricane staffing procedure provides specific guidance for crew staffing levels and for the process of sequestering storm crews." Does the hurricane staffing procedure or other site procedures define the conditions necessary to sequester site personnel?

Please provide that procedural reference and guidance.
