ME9144 AND ME9145)

Dear Mr. Larson:

By letter dated July 25, 2012 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML 12208A309), FirstEnergy Nuclear Operating Company (FENOC) submitted a proposed amendment to the Beaver Valley Power Station, Unit Nos. 1 and 2, Technical Specifications (TSs). The proposed amendment would modify TS 3.1.3 to allow the normally required near-end-of-life Moderator Temperature Coefficient (MTC) measurement to not be performed under certain conditions.

If these conditions are met, the MTC measurement would be replaced by a calculated value. On November 29,2012, a draft request for additional information (RAI), with three questions, was sent to Mr. Phil Lashley, of your staff. The draft questions were sent to ensure that they were understandable, the regulatory basis was clear, and to determine if the information was previously docketed.

The questions were discussed with your staff on December 5, 2012, and were formally transmitted to you on December 28, 2012 (ADAMS Accession No. ML 12340A256).

In order to facilitate an RAI response, the NRC staff agreed to hold a public meeting (portions closed due to discussion of proprietary information) with FENOC. The purpose of the meeting was to discuss proposed responses to the RAI in advance of FENOC providing an official docketed response.

This meeting was held on February 20, 2013 (see ADAMS Accession Nos. ML 13023A 175 and ML 13057 A678). At the conclusion of the meeting, FENOC stated that they would contact the NRC staff to agree upon a strategy and timetable for providing the RAI response to the NRC. The NRC staff has reviewed the content of the RAt questions and has concluded that a response to RAI question number three is not required.

The staff has determined that the other two questions adequately capture the information needed, at this point in the review, to evaluate the license amendment request (LAR).

E. Larson -2 Therefore, you are requested to provide a response to question numbers one and two of the RAI dated December 28,2012, within 30 days of this letter. If a response is not received by that date, the LAR will be subject to denial, pursuant to Title 10 of the Code of Federal Regulations, Section 2.108, "Denial of application for failure to supply information." In addition, due to the current status of the LAR review, the NRC staff cannot provide any assurance that FENOC's requested LAR disposition date of August 2, 2013, will be met.
