Dear Mr. Martinelli:

I am writing with regard to your e-mail communication of September 21, 2007, in which you presented a "formal request under the guidelines of 10 CFR 2.206 . . . that the Environmental Costs of a targeted terrorist attack on Indian Point be included in the [environmental impact]

scoping process for Indian Point [license renewal]." By letter dated October 24, 2007, Mr. Ho Nieh of the Nuclear Regulatory Commission (NRC) Office of Nuclear Reactor Regulation (NRR) responded to your request, stating that it does not meet the criteria for consideration as a petition under 10 CFR § 2.206, but that your request would be reviewed by the NRR Division of License Renewal (DLR).

The DLR has reviewed your e-mail communication and has determined that no further action is warranted at this time. In a letter to Susan Shapiro of FUSE dated July 25, 2007, responding to her letter of June 26, 2007, I noted that the Commission had reaffirmed its position on this issue in Amergen Energy Co., LLC (Oyster Creek Nuclear Generating Station), CLI-07-8, 65 NRC 124 (2007), in which the Commission concluded, in part, that "National Environmental Policy Act does not require the NRC to consider the environmental consequences of hypothetical terrorist attacks on NRC-licensed facilities." Id. at 129. Inasmuch as your comment concerns the scope of the Environmental Impact Statement to be prepared for the Indian Point license renewal application, it will be considered along with other comments received c oncerning t he scoping process.
