In the Matter of ) Docket Nos. 50-438 Tennessee Valley Authority ) 50-439 BELLEFONTE NUCLEAR PLANT (BLN) UNITS 1 AND 2 --NOTIFICATION:

CONSTRUCTION PERMITS CPPR-122 (UNIT 1) AND CPPR-123 (UNIT 2) PLACED IN TERMINATED STATUS The purpose of this letter is to inform the NRC that TVA has placed BLN Units 1 and 2, located in Hollywood, Alabama, in terminated status.Within 90 days from the date of this letter, TVA will submit a request for withdrawal of construction permits CPPR-122 and CPPR-123 for BLN Units 1 and 2, respectively, along with the site redress plan for NRC approval.

As of October 1, 2005, TVA ceased equipment lay-up activities and associated inspections as allowed by the Nuclear Quality Assurance Plan. Due to the deferral of these units, there has been no nuclear fuel located at the site for several years, and TVA has removed safeguards information from the site.The construction permits for the present BLN units were obtained from the NRC in 1974 using a new Babcock and Wilcox pressurized water reactor design. Though several U.S. plants were anticipated utilizing this design, none were completed and placed into commercial operation.

As a result of a reduction in forecasted load growth, construction of the BLN units was deferred in 1985 and 1988. In December 1994, TVA determined that it would not, by itself, complete those units. In June 2005, the TVA Board of Directors approved amortizing TVA's investment in the deferred BLN nuclear generating units' costs over ten years. Also, in November 2005, TVA's Board approved the cancellation of the BLN construction project.Prited on recycled pNper r U.S. Nuclear Regulatory Commission Page 2 December 12, 2005 The BLN plant site is also under consideration for the possible location of an advanced technology nuclear plant. Canceling construction of the existing facility and withdrawal of the construction permits are necessary in order to close out the existing BLN project and facilitate the future use of the BLN site for the benefit of TVA's ratepayers.
