ME1515, ME1516, AND ME1517)

Dear Mr. Swafford:

By letter dated June 19, 2009, the Tennessee Valley Authority (TVA) applied for amendments to the Browns Ferry Nuclear Plant, Units 1, 2, and 3, Renewed Operating Licenses Nos. DPR-33, DRP-52, and DPR-68, respectively.

The proposed amendments would have allowed a one-time extension of the emergency diesel generator (EDG) out of service Technical Specification completion time from 7 to 14 days. Subsequently, by letter dated July 28, 2009, you withdrew the amendment request. The purpose of this letter is to advise that the above-cited application is being treated as withdrawn.

Should you decide to resubmit, it is expected that the submittal should include a safety basis that justifies the requested extension to 14 days, taking into account the cumulative effect of having each of the EDGs out of service. A complete schedule should be provided of the planned outages for all EDGs during the maintenance activities, including, how much time will be provided between outage of one EDG to another. Additional information needs and considerations were identified in the U.S. Nuclear Regulatory Commission's letters to TVA dated August 17, 2006, and July 10, 2009, and should be addressed as appropriate.

No Notice of Consideration of Issuance of the proposed amendment has been published in the Federal Register.
