Millstone 2 Exemption Request Regarding 10 CFR 50, Appendix R, III.G.2 Acceptance Review Bill, By letter dated June 30, 2011 (Agencywide Documents Access and Management System Accession No. ML11188A213), Dominion Nuclear Connecticut, Inc. (DNC or the licensee) submitted an exemption request for Millstone Power Station, Unit No. 2 (MPS2). The proposed exemption would allow the use of operator manual actions in lieu of the requirements of Title 10 of the Code of Federal Regulations (10 CFR), Part 50, Appendix R, Paragraph III.G.2, "Fire protection of safe shutdown capability." The purpose of this e-mail is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff

=s acceptance review of this exemption request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Pursuant to 10 CFR 50.12, "Specific exemptions," the Commission may, upon application by any interested person or upon its own initiative, grant exemptions from the requirements or 10 CFR Part 50 when the exemptions are authorized by law, will not present an undue risk to the public health and safety, are consistent with the common defense and security, and special circumstances are present as described in 10 CFR 50.12(a)(2).

The NRC staff has reviewed your exemption request and concluded that it does provide technical information in sufficient detail to enable the NRC staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed request in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staff's ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. You will be advised of any further information needed to support the NRC staff
