By letter dated May 20, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21140A299), Dominion Energy Nuclear Connecticut, Inc.

submitted an affidavit dated May 4, 2021, executed by Camille T. Zozula, on behalf of Westinghouse Electric Company, LLC (Westinghouse), requesting that the information contained in the following document be withheld from public disclosure pursuant to Section 2.390 of Title 10 of the Code of Federal Regulations (10 CFR):

LTR-LIS-21-115, Attachment 1 (DENCs response to RAI in Attachment 3, May 20, 2021, Serial No.21-154 (Proprietary portions))

A nonproprietary copy of these documents has been placed in the U.S. Nuclear Regulatory Commissions (NRCs) Public Document Room and added to the NRC Library in ADAMS under Accession No. ML21140A299.

The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

(a) The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of Westinghouses competitors without license from Westinghouse constitutes a competitive economic advantage over

other companies.

(c) Its use by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, and assurance of quality, or licensing a similar product.

We have reviewed your application and the material accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the affidavit, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.

Therefore, the version of the submitted document marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.

Rich, To clarify, LTR-LIS-21-115 is the letter number that Westinghouse used for their technical input to RAI #1 and #2 responses (Dominion developed the RAI #3 response). We took the content from LTR-LIS-21-115 and formatted it into our Dominion RAI response template for Serial No 21-154.

Therefore, the proprietary portions of Westinghouse letter LTR-LIS-21-115, Attachment 1 are the same as the proprietary portions of DENCs response to RAI in Attachment 3, May 20, 2021, Serial No.21-154, and your proposed suggestion below is acceptable to us.

Tim, Below is a standard communication that I send back to the licensee acknowledging the receipt of documentation in which information is being requested to be withheld from public disclosure under 10 CFR 2.390. I noted that for the subject letter dated May 20, 2021 (attached), the affidavit executed by Camille T. Zozula specifies a document that I dont readily identify within the letter:

(2) I am requesting the proprietary portions LTR-LIS-21-115, Attachment 1 be withheld from public disclosure under 10 CFR 2.390 Can you verify the intended document w/proprietary portions being requested to be withheld? If the stated LTR-LIS-21-115, is indeed in error, please confirm that the affidavit as corrected should refer to the proprietary portions of DENCs May 20, 2021, RAI

response in Attachment 3; as a suggestion, I propose the document title as shown in red italics below.
