June 11, 2010 ORDER (Granting Consent Motion Regarding Privilege Logs)

On May 13, 2010, this Atomic Safety and Licensing Board (Board) issued an Order defining the scope of disclosure in this proceeding.

1 The Board's May 13 Order requires that "[i]f a party seeks to withhold documents as privileged or otherwise protected, it must provide a privilege log, pursuant to 10 C.F.R. §§ 2.336(a)(3) and (b)(5)."

2 On June 10, 2010, Applicant Northern States Power Company (NSPM), on its own behalf and on behalf of the Prairie Island Indian Community (PIIC) and the NRC Staff (collectively, the Parties), filed a Consent Motion Regarding Privilege Logs with the Board seeking approval of an agreement reached by the parties regarding the production of privilege logs for the mandatory disclosures in this proceeding.

3 The Parties state they "have agreed to waive the requirement to include in the privilege logs those documents claimed to be covered by 1 Licensing Board Order (Defining Scope of Disclosure) (May 13, 2010) (unpublished).

the attorney-client and attorney work product privileges."

4 The Parties indicate they "will still produce a log identifying documents claimed under privileges other than attorney-client and attorney work product."
