ALTERNATIVE DISPUTE RESOLUTION SESSION ON SEPTEMBER 18, 2013

Dear Mr. Pacilio:

This letter confirms the discussion between your attorney, Ms. Tamra Domeyer, and Ms. Patricia Lougheed, Senior Enforcement Coordinator, U.S. Nuclear Regular Commission (NRC) Region III, establishing the date for an Alternative Dispute Resolution (ADR) session. The meeting will begin at 9:00 a.m. CT on September 18, 2013, at the Region III offices located at 2443 Warrenville Road, Lisle, Illinois, 60532. The mediator will be Mr. Warren Cunningham.

Alternative dispute resolution, as employed by the NRC, is a mediated opportunity to discuss issues, clear up misunderstandings, be creative, find areas of agreement, and reach a final resolution of the issues.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the NRC's Agencywide Documents Access and Management System (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
