There were four specific requests, made in the previous LAR submittal, which are tied to Item 4 of the NRC acceptance review letter. These are as follows:
: 1. The use of Ductility Ratios
: 2. The use of Inelastic Absorption Factors
: 3. The use of Dynamic Increase Factors
: 4. The use of Limit Design Method As was discussed with the NRC via teleconference, items one and two have been removed from the LAR. Items three and four have been retained. Specifically, the use of Dynamic Increase Factors in accordance with ACI-349 Appendix C is being requested but details have been added for clarification. This is in accordance the meeting note, and keep DIF when allowed by ACI 349, App. C." Additionally, there was no indication made within the NRC acceptance review letter that the use of the Limit Design Method is considered to be inappropriate. Therefore, the request to use the Limit Design Method has been retained.

The licensee is still asking to use Appendix C of ACI 349 methodology (Item 4 of the LAR: use of limit design method for evaluation of RC&C --- Section 3.4 of the LAR). This item was in the original LAR (language has been changed but the essence of the request is the same).
We discussed this item in our teleconference with you and our understanding was that you were going to withdraw the use of Appendix C methodology and only include the use of DIF (I had written in my notes from the call that, the licensee would "withdraw the Item 4 exceptions and keep DIF when allowed by ACI 349, App.
C.").
Are we missing something here? With the exception of the use of DIF, Item 4 (described in Section 3.4 of the LAR) seems to have the same problems as noted before.
My goal here is to get the LAR past LIC-109 (sufficient information is available to begin the technical review) and into LIC-101 (making a regulatory decision based on the technical review). Thanks, Fred
