Part 2, the Depart-ment of Justice respectfully moves the Board for an order requiring Applicant ,to provide computer access, input data, and printouts in order for the Department to prepare a study for submissicn as rebuttal evidence in this proceeding.

The Department, by letters to Chairman Garfinkel, dated Septe=ber 13,-1973 and September 20, 1973 (Appendix A and B respectively), advised the Board of the status of our request for discovery of the above material.          Since that time an understanding has been reached with counsel for Applicant and we have every reason to believe that whatever materials are needed to prepare cur rebuttal case will be forthcoming.

Since our discovery request is not truely in contro-versy at this time, and indeed will in all likelihood be complied uith, we presently expect neither a response by Applicant nor a ruling by the Board. If in the future any problem should arise regarding access to the requested computer material, we would contemplate at that time advising the Board that this motion is ripe for a ruling, giving, of course, Applicant a reasonable time to respond.
