UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 November 3, 2015

Mr. Warren Chris Swartz, Jr., President Keweenaw Bay Indian Community 16429 Beartown Rd Baraga, MI 49908

SUBJECT:

NOTICE OF AVAILABILITY OF THE DRAFT SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT FOR LICENSE RENEWAL OF FERMI UNIT 2, FOR PUBLIC COMMENT

Dear President Swartz:

The U.S. Nuclear Regulatory Commission (NRC) is conducting an environmental review of the effects of renewing the operating license for Fermi 2. Fermi 2 is located in Monroe County, Michigan, approximately 30 miles southwest of Detroit, Michigan, and 7 miles from the United States-Canada border. Fermi 2 is operated by DTE Electric Company (DTE). As part of its review, the NRC has completed a draft Supplemental Environmental Impact Statement (SEIS) for the license renewal of Fermi 2. This letter is to inform you and members of your tribe that the draft SEIS for the license renewal of Fermi 2 is available for public comment. The SEIS includes analyses of relevant environmental issues, including potential impacts to historic, archeological, and cultural properties from continued plant operation associated with license renewal.

As stated in our letter to your tribe dated July 8, 2014, the NRC is conducting Section 106 consultations in compliance with the National Historic Preservation Act (NHPA) through the requirements of the National Environmental Policy Act (NEPA), as outlined in 36 CFR 800.8(c).

In the context of NEPA, the NRC's preliminary determination is that any impact from continued power plant operations and maintenance activities during the license renewal term on historical and archaeological resources located in the area of potential effect would be small. Under the provisions of NHPA, the NRC determined that no historic properties would be affected by this undertaking (the renewal of the Fermi 2 operating license)

. The justification for these conclusions is explained in the draft SEIS.

As discussed in the draft SEIS, the NRC's recommendation is that the adverse environmental impacts of license renewal for Fermi 2 are not so great that preserving the option of license renewal for energy-planning decisionmakers would be unreasonable. This recommendation is based on (1) the analysis and findings in NUREG 1437, "Generic Environmental Impact Statement (GEIS) for License Renewal of Nuclear Plants, Revision 2;" (2) the environmental report submitted by DTE; (3) consultation with Federal, State, Tribal and local agencies; (4) the NRC's environmental review; and (5) consideration of public comments received during the scoping process.

A copy of the draft SEIS with these conclusions is enclosed. Pursuant to 36 CFR 800.8(c), we are requesting your comments on the draft supplement and on our preliminary conclusions. Electronic comments on the draft SEIS may be submitted to the NRC by accessing www.regulations.gov and searching for Docket ID NRC-2014-0109. Written comments should be submitted by mail to: Cindy Bladey, Chief Rules, Announcements, and Directives Branch (RADB)

Office of Administration, Mail Stop: OWFN-12-H08 U.S. Nuclear Regulatory Commission Washington, DC 20555-0001 Please note that the public comment period for the draft SEIS ends on December 28, 2015.

SUBJECT:

NOTICE OF AVAILABILITY OF THE DRAFT SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT FOR LICENSE RENEWAL OF FERMI UNIT 2, FOR PUBLIC COMMENT

Dear Tribal Chairperson Meshigaud:

As stated in our letter to your tribe dated July 8, 2014, the NRC is conducting Section 106 consultations in compliance with the National Historic Preservation Act (NHPA) through the requirements of the National Environmental Policy Act (NEPA), as outlined in 36 CFR 800.8©.

Pursuant to 36 CFR 800.8©, we are requesting your comments on the draft supplement and on our preliminary conclusions. Electronic comments on the draft SEIS may be submitted to the NRC by accessing www.regulations.gov and searching for Docket ID NRC-2014-0109. Office of Administration, Mail Stop: OWFN-12-H08 U.S. Nuclear Regulatory Commission Washington, DC 20555-0001

Please note that the public comment period for the draft SEIS ends on December 28, 2015.

NOTICE OF AVAILABILITY OF THE DRAFT SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT FOR LICENSE RENEWAL OF FERMI UNIT 2, FOR PUBLIC COMMENT

Dear Chief Friend:

SUBJECT:

NOTICE OF AVAILABILITY OF THE DRAFT SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT FOR LICENSE RENEWAL OF FERMI UNIT 2, FOR PUBLIC COMMENT

Dear Chairman Warren:

NOTICE OF AVAILABILITY OF THE DRAFT SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT FOR LICENSE RENEWAL OF FERMI UNIT 2, FOR PUBLIC COMMENT

Dear Chief Sparkman:

Pursuant to 36 CFR 800.8©, we are requesting your comments on the draft supplement and on our preliminary conclusions.
