1999, REQUEST FOR TIME EXTENSION TO THE FUNDAMENTAL NUCLEAR                        l MATERIAL CONTROL PLAN COMMITMENTS BACKGROUND By cover {{letter dated|date=January 8, 1998|text=letter dated January 8,1998}}, ABB Combustion Engineering (CE) requested a one-              l time amendment authorizing a time extension, beyond the normal 30-day time frame, for              i completing receipt measurements and distributing related Nuclear Material Transaction Report DOE /NRC Form 741 with regard to seven UF, cylinders received from Siemens in December 1998. This amendment request, which relieves CE from commitments in Section 4.3.1 of its FNMC Plan, was processed following the provisions of 10 CFR 70.34.
DISCUSSION The material consists of seven 2.5-ton UF, cylinders at 4.0-4.9% enrichment levels. The cylinders, which were originally filled at the Portsmouth Gaseous Diffusion Plant, were shipped    l to CE by another licensed facility, Siemens Nuclear Division in Richland, Washington. CE confirmed that the cylinders arrived at its site in inviolate and tamper-safe condition but without representative samples (P-10 tube samples) for measurement verification purposes. The absence of the samples is due to subsequent transfer between facilities.
CE used an alternative method for measurement verification allowed in Section 4.3.1 of its approved FNMC Plan by completing net weight determination and nominal weight fraction for uranium element, but cannot determine the U-235 content because the NDA equipment and procedures are not currently in place. Alternatively, CE plans to determine the U-235 content by analyzing a UO2F, sample withdrawn during the hydrolysis stage of the UF, conversion process. However, because of the material planning and production schedule, CE could not meet the 30-day requirement specified in Section 4.3.1 of its FNMC Plan, which requires CE to complete all confirmatory receipt measurements and distribute DOE /NRC Form 741 within the required time frame. Therefore, a time extension up to April 1,1999, has been requested. This requested extension of time is necessary and appropriate in order for the licensee to schedule resources and activities to accommodate the required measurements, and in particular CE does not intend to depart from commitments of its measurement and measurement control program.

        .                                                    2 ENVIRONMENTAL REVIEW The staff has determined that the requested time extension involves safeguards plan and material accountability which are categorically excluded from the requirements to prepare a site-specific environmental assessment. Therefore, in accordance with 10 CFR 51.22(c)(12),
neither an environmental assessment nor an environmental impact statement is warranted for this action.
CONCLUSION The staff concludes that granting the licensee's time extension request for completing receipt measurements and distributing DOE /NRC Form 741 of received UF, cylinders is justified and warranted, and that it will not reduce the effectiveness of the licensee's safeguards program.
Therefore, a temporary (one-time) Safeguards Condition SG-1.8 is being issued which allows for the extension of time.
