SAFEGUARDS EVALUATION REPORT: SUBMITTAL DATED SEPTEMBER 20,1999 - REQUEST FOR TEMPORARY CHANGE TO UFe RECEIPT SAMPLING PROCEDURE BACKGROUND By cover letter dated September 20,~ 1999, CE requested a delay beyond the normal 30 days for completing material receipt verification measurements and distributing the nuclear material transaction report DOE /NRC Form 741. CE submitted the request following a telephonic
- discussion with NRC licensing staff in anticipation of the need for a temporary change to the
= material sampling system procedure. The amendment in response to this request would relieve the licensee from commitments in Section 4.3.1 of its Fundamental Nuclear Material Control (FNMC) Plan.
DISCUSSION ~
CE received three UFs ylinders from another facility (General Electric Nuclear Energy at c
Wilmington) that had already been filled and sampled by the vendor (U.S. Enrichment Corporation). The subject cylinders arrived at the facility site in an original and inviolate seat m
. condition but without small P-10 representative samples. When witnessing of the filling and sampling of the UF,is not done, as an approved altemate safeguards measure, the lMensee
.will analyze the UO F samples produced from the cylinders during its conversion procus to 22 confirm the vendor's measurement values. Recent problems encountered during

September 1999 at the UFs torage dock prevented CE from processing these cylinders oc s
~ schedule. Consequently, CE will not be able to complete all receipt measurements and distribute Form 741 within the allotted time, thus has requested a time extension. This request.
is appropriate since the licensee will not depart from any other commitments described in its approved FNMC Plan with regard to the material measurement and reporting requirements.

The. staff has determined that the requested time extension involves safeguards plan and l}
. material accountability which are categorically excluded from the requirements to prepare a L
. site-specific environmental assessment. Therefore, in accordance with 10 CFR 51.22(c)(12),
neither an environmental assessment nor an environmental impact statement is warranted for i

2 CONCLUSION The staff concludes that granting the licensee's time extension request associated with the change to the UF receipt sampling procedure and completion of verification measurements is e
justified and warranted, and that it will not reduce the effectiveness of the licensee's safeguards program. Thus, a temporary Safeguards Condition SG-1.10 is being issued which allows for the limited extension of time. In addition, an expired License Condition SG-1.9 has been deleted.
The Operations Branch (FCOB) inspection staff has no objection to this proposed action.

l In accordance with your correspondence dated September 20,1999, and pursuant to Part 70 to LTitle 10 of the Code of Federal Regulations, Materials Lice'nse SNM-33 is hereby amended to allow the requested time extension to certain commitment in the Fundamental Nuclear Material Control (FNMC) Plan regarding a temporary change to,UFs receipt sampling procedure.
