The April 18, 2006, weekly discharge sample of Biological Oxygen Demand 5-day (BOD) from the Davis-Besse Nuclear Power Station (DBNPS) National Pollutant Discharge Elimination System (NPDES) Permit 21B0001B *GD Outfall 601 (Wastewater Treatment Pond) measured 66 mg/I. The BOD daily limit at Outfall 601 is 45 mg/I. This letter provides the five-day written confirmation, as required by the DBNPS NPDES Permit, of a permit nonconformance.
 
The BOD analyses are performed by a contract laboratory and results are provided by routine mail-services.

A review of the BOD analysis results did not indicate an adverse trend.The previous BOD sample result on April 11, 2006, measured 31 mg/l and the following BOD sample result on April 25, 2006, measured 30 mg/I.This incident is not believed to have been caused by operational error, improperly designed treatment facility, inadequate treatment facility, lack of preventative maintenance or improper operation.
The BOD analyses are performed by a contract laboratory and results are provided by routine mail-services. The April 18, 2006, sample results were received by DBNPS on May 8, 2006. A review of the BOD analysis results did not indicate an adverse trend.
This occurrence was an exceptional incident in that there was an unintentional and temporary noncompliance with technology-based effluent limitations, which appear to be beyond Davis-Besse's control.
