In a letter to the Nuclear Regulatory Commission (NRC) dated October 31, 2006, ConsumersEnergy Company (Consumers), Entergy Nuclear Palisades, LLC (ENP), and Energy Nuclear Operations (ENO) submitted an application requesting that the NRC approve the direct transfer of Consumers' interest in Facility Operating License No. DPR-06 for the Big Rock Point nuclear reactor, as well as the General License No. SFGL-16 for the Big Rock Point Independent Spent Fuel Storage Installation (ISFSI) to ENP, as owner, and ENO, as operator of the ISFSI. The application requested approval for ENP to possess and own, and ENO, to operate, the Big Rock Point ISFSI and certain adjacent lands. The application also requested approval of the conforming amendment to the license pursuant to 10 CFR 50.80 and 50.90. Notice of the application was published in the Federal Register (FR) on January 30, 2007 (72 FR 4302-4303). The NRC staff has completed its review of the application, and concludes that: (1) theproposed transferee is qualified to be the holder of the license; and (2) the transfer of the license is otherwise consistent with applicable provisions of law, regulations, and orders issuedby the Commission. As such, the Commission approves the order approving the direct transfer of Consumers' interest in Facility Operating License No. DPR-06 and general ISFSI License No. SFGL-16. Enclosure 1 is the Order which approves the proposed license transfer, subject to the conditions described therein, and the conforming amendment. Enclosure 2 provides conforming amendment pages for Big Rock Point. The conforming amendment will be issued and become effective at the time the transfer is consummated. Enclosure 3 contains the non-proprietary version of the NRC staff's Safety Evaluation Report (SER) related to the preceding actions. The non-proprietary version of the SER will be placed in the NRC public document room and added to the Agencywide Documents Access and Management System's Publicly Available Records System Library.
