PALISADES NUCLEAR PLANT AND BIG ROCK POINT PLANT - ISSUANCE OF AMENDMENT NOS. 129 AND 273 RE: ORDER APPROVING TRANSFER OF LICENSES AND CONFORMING ADMINISTRATIVE LICENSE AMENDMENTS (EPIDS L-2022-LLM-0002 AND L-2020-LLM-0003)
Dear Mr. Oneid and Mr. Trice:
By order dated December 13, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21292A146), the U.S. Nuclear Regulatory Commission (NRC) staff approved (1) the transfer of Renewed Facility Operating License No. DPR-20 for the Palisades Nuclear Plant (Palisades), the general license for the Palisades independent spent fuel storage installation (ISFSI), Facility Operating License No. DPR-6 for the Big Rock Point Plant (Big Rock Point), and the general license for the Big Rock Point ISFSI (referred to collectively as the Sites and the licenses) to a Holtec International (Holtec) subsidiary to be known as Holtec Palisades, LLC (Holtec Palisades) and (2) the transfer of Entergy Nuclear Operations, Inc.s (ENOIs) operating authority (i.e., its authority to conduct licensed activities at the Sites) to Holtec Decommissioning International, LLC (HDI). The order also approved draft conforming administrative amendments to the licenses to reflect the transfer.
By letter dated June 24, 2022 (ML22175A106), ENOI notified the Directors of the NRCs Office of Nuclear Material Safety and Safeguards (NMSS) and Office of Nuclear Reactor Regulation (NRR) of the planned date of closing (June 28, 2022) of the license transfer transaction.
P. Oneid and By letter dated June 24, 2022 (ML22178A077), HDI provided the Directors of NMSS and NRR satisfactory documentary evidence that Holtec Palisades and HDI have:
(1) entered into a decommissioning operator services agreement that provides for HDI to act as agent for Holtec Palisades and for Holtec Palisades to pay HDIs costs of post-shutdown operations, including decommissioning and spent fuel management costs; (2) obtained the appropriate amount of insurance required of a licensee under Title 10 of the Code of Federal Regulations (10 CFR) 140.11(a)(4) and 10 CFR 50.54(w);
(3) established a fund satisfying the prepayment method of 10 CFR 72.30(e)(1) for decommissioning for the Big Rock Point ISFSI; and (4) established a fund containing one years worth of estimated operating costs, along with a parent support agreement to continually maintain that fund with one years worth of estimated operating costs,for the Big Rock Point ISFSI.
On June 28, 2022 (ML22179A075), ENOI informed the NRC that the transfer transaction closed on June 28, 2022. Accordingly, the NRC staff is issuing the enclosed Amendment No. 129 to Facility Operating License No. DPR-6 for Big Rock Point (Enclosure 1) and Amendment No. 273 to Renewed Facility Operating License No. DPR-20 for Palisades (Enclosure 2). A copy of the related safety evaluation (ML21292A148) was provided with the order dated December 13, 2021, approving the license transfer and the conforming amendments. Notice of Issuance of the conforming amendments will be included in the NRCs monthly Federal Register notice.
This letter also contains digitally signed copies of Amendment No. 20 to Indemnity Agreement No. B-22 for Big Rock Point (Enclosure 3) and Amendment No. 13 to Indemnity Agreement No. B-40 for Palisades (Enclosure 4). We request that all parties sign the amendments, and return one copy of each including all signatures to the NRCs Document Control Desk as proof of acceptance. Please keep signed original copies for each partys records.
In accordance with 10 CFR 2.390, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. ADAMS is accessible from the NRC website at https://www.nrc.gov/reading-rm/adams.html.
