REPLY TO ENTERGY LETTERS REGARDING THE SIREN PROJECT MILESTONE SCHEDULE AND PROVIDING NRC PLANNED ACTIONS

Dear Mr. Balduzzi:

The purpose of this letter is to acknowledge the siren project milestone schedule update letters from Entergy dated July 25, August 8, August 12, and August 26, 2008. Additionally, this letter discusses planned NRC inspection activities regarding the closure of the Orders dated January 31, 2006 (EA-05-190) and July 30, 2007 (EA-07-189), and the August 22, 2008, Confirmatory Action Letter (1-08-005), regarding tone alert radios (TARs).

On August 22, 2008, the Federal Emergency Management Agency (FEMA) granted approval for Entergy to place the new Alert and Notification System (ANS) for the Indian Point Energy Center in service. On August 27, 2008, Entergy placed the new ANS in service and declared the system operable. By placing the system in service, Entergy has satisfied the schedule commitments made to the NRC in your February 8, 2008, Siren Project Milestone Schedule letter. While placing the system in service completes a major project milestone, additional actions are needed to fulfill remaining requirements and commitments. The NRC Orders require three consecutive siren tests to demonstrate system reliability in addition to FEMA (FEMA-REP10) system reliability testing requirements. Your commitment to deploy TARs, to certain households within the emergency planning zone, beyond five miles from the site by November 1, 2008, is also an ongoing activity necessary for project completion.

In accordance with our Reactor Oversight Process Deviation Memorandum, dated December 19, 2007 (ADAMS ML073480290), the NRC will continue to conduct focused inspections of the ANS in addition to the baseline inspection modules. Specifically, we plan to inspect the ANS reliability testing and the TAR deployment program. At the conclusion of these activities, we will conduct a final onsite inspection to assess your actions to comply with the ANS Orders, commitments to deploy the TARs, and your performance in evaluating the causes of the delay in implementing the replacement ANS and your corrective actions. The date for this inspection is scheduled for the week of November 17, 2008, based on your current schedule for completion of the testing and deployment activities. The NRC requests that you keep us informed of your reliability testing schedule and notify us of any changes to your completion dates.

Our oversight activities will include, but not be limited to, review of your siren reliability test results and actions to ensure that the old siren system remains available to be placed back in service, if required.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter, and your response, if you choose to provide a response, will be made available electronically for public inspection in the NRC Public Document Room or from the NRC=s document system (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.

Therefore, to the extent possible, any such response should not include any personal privacy, proprietary, or safeguards information so that it can be made available to the public without redaction.
