ASLBP No. 15-935-02-LA-BD01 March 30, 2015 ORDER (Extending the Deadline for Submittal of Initial Disclosures) On March 23, 2015, we granted Citizens Allied for Safe Energy, Inc.'s (CASE) petition to intervene and request for a hearing on license amendments issued to the Florida Power & Light Company's (FPL) Turkey Point Nuclear Generating Units 3 and 4.

1 NRC regulations require that, thirty (30) days from the grant of a hearing request or petition to intervene, all parties to the proceeding, including the NRC Staff, must comply with certain initial disclosure requirements.

2 FPL and CASE are required to provide (1) the identity of witnesses or experts on which they may rely at hearing, along with copies of the analysis or other authority on which the witness bases his or her opinion; (2) documents that are relevant to the admitted contention; and (3) a list of documents over which a privilege is claimed.

3 The NRC Staff must provide (1) the application that is the subject of the admitted contention; (2) NRC correspondence with FPL that 1 LBP-15-13, 81 NRC __, __ (slip op. at 23-24) (Mar. 23, 2015).

3 10 C.F.R. § 2.336(a). is relevant to the admitted contention; and (3) all documents that support the Staff's review of the application and are relevant to the admitted contention.

4 On March 26, 2015, all three parties jointly moved for a 90-day extension for submittal of section 2.336 initial disclosures - from April 22, 2015 to July 21, 2015.

5 The parties request such a delay due to (1) "significant near-term deadlines and obligations that would demand the same resources as document production"; and (2) the fact that FPL intends to file a petition for review of the Board's ruling, pursuant to 10 C.F.R. § 2.311(b).

6 Though appreciative of the parties' resource concerns, the Board wishes to move forward as expeditiously as possible, without unduly delaying the conduct of an evidentiary hearing. As such, the Board grants the parties a 30-day extension of the deadline for disclosures obligations. The new due date for initial disclosures by all parties is May 22, 2015. The joint motion also proposed a number of other additions and modifications to the disclosure requirements for this proceeding.

7 The Board will address all of these concerns in a scheduling order to be issued soon. It is so ORDERED.
