Dear.Mr.Denton:

Carolina Power R Light Company on behalf of itself and the North Carolina Eastern Municipal Power Agency, being the holders of Construction Permit CPPR-158 for the Shearon Harris Nuclear Power Plant, Unit 1, hereby requests an amendment to the Construction Permit (CPPR-158) to reflect the exemption from GDC 0 requested by our letters of January 10, April 19, and May 9, 1985.This request supercedes our previous request, NLS-85-080 dated May 9, 1985.Paragraph 3 of the Construction Permit states, in part, as follows: This permit shall be deemed to contain and be subject to the conditions specif ied in Section 50.50 and 50.55, of said regulations; is subject to all applicable provisions of the Act, and rules, regulations, and order of the Commission now or hereafter in effect;...

We request that paragraph 3 be amended by inserting"except to the extent applicants obligations thereunder may be modified by duly authorized exemptions" after the words"in effect" and before the semicolon.
