In accordance with the Code of Federal Regulations, Title 10, Parts 50.90 and 2.101, Carolina Power & Light Company (CP6L) hereby requests a revision to the Technical Specifications.(TS) .for the Shearon Harris Nuclear Power Plant (SHNPP).

The proposed amendment revises TS Surveillance Requirement 4.0.3 and its associated Bases. This will provide for a delay period in which to perform a surveillance which has been discovered not to have been performed within its specified frequency. This change is an adoption of the requirements contained in NUREG-1431, "Standard Technical Specifications, Westinghouse Plants." provides a detailed description of the proposed change and the basis for the change. details, in accordance with 10 CFR 50.91(a), the basis for the Company's determination that the proposed change does not involve a significant hazards consideration. provides an environmental evaluation which demonstrates that the proposed amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51 '2(c)(9). Therefore, pursuant to 10 CFR 51.22(b), no environmental assessment needs to be prepared in connection with the issuance of the amendment. provides page change instructions for incorporating the proposed revision. provides the proposed Technical Specification pages.

~Back round Plant Technical Specification (TS) Surveillance Requirement 4.0.3 currently specifies that the failure to perform a Surveillance within its specified time interval shall constitute a failure to meet the operability requirements for that particular system or equipment. As a result of being declared inoperable, immediate steps may be required to initiate mode changes or a plant shutdown in accordance with the applicable TS Action Statements. Such measures challenge plant systems and subject the plant to unnecessary transient conditions with their accompanying risks and operational impacts. NRC Generic Letter 87-09 acknowledged this problem; thus, changes to the Standard TS were incorporated in NUREG-1431, "Standard Technical Specifications, Westinghouse Plants."

Pro osed Chan e The proposed .amendment revises TS Surveillance Requirement 4.0.3 and its associated Bases. This will provide for a delay period of up to 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> in which to perform a surveillance which has been discovered not to have been performed within its specified frequency. This change is an adoption of the requirements contained in NUREG-1431, "Standard Technical Specifications, Westinghouse Plants."

Basis This change will reduce the potential for unnecessarily manipulating or challenging plant systems and equipment. A delay period will permit completion of a surveillance before applying remedial steps that will preclude completion of the surveillance. As stated in the Bases to NUREG-1431, "[t]he basis for this delay period includes consideration of unit conditions, adequate planning, availability of personnel, the time required to perform the Surveillance, the safety significance of the delay in completing the required Surveillance, and the recognition that the most probable result of any particular Surveillance being performed is the verification of conformance with the requirements."

Conclusions The proposed change will not introduce any new equipment, nor will it require existing plant systems to perform a different type of function than they are currently designed to perform. The change will reduce the potential for unnecessarily manipulating or challenging the plant systems and equipment and will not result in changes to procedures which affect the operation of those plant systems. Since the design, operation, and manner in which testing is performed is unchanged, and the addition of a delay period is insignificant Page El-1

NPF-63 REQUEST FOR LICENSE AMENDMENT PERFORMANCE OF TECHNICAL SPECIFICATION SURVEILLANCES 10 CFR 50.92 EVALUATION The Commission has provided standards in 10 CFR 50.92(c) for determining whether a significant hazards consideration exists. A proposed amendment to an operating license for a facility involves no significant hazards consideration if operation of the facility in accordance with the proposed amendment would not: (1) involve a significant increase in the probability or consequences of an accident previously evaluated, (2) create the possibility of a new or different kind of accident from any accident previously evaluated, or (3) involve a significant reduction in a margin of safety. Carolina Power & Light Company has reviewed this proposed license amendment request and determined that its adoption would not involve a significant hazards determination. The bases for this determination are as follows:

Basis This change does not involve a significant hazards consideration for the following reasons:

The proposed amendment does not involve a significant increase in the probability or consequences of an accident previously evaluated.

The proposed change will reduce the requirement to unnecessarily manipulate and challenge plant systems and equipment. The most probable result of performing a surveillance during the delay period will be to verify its conformance with Technical Specification requirements. Since this change does not affect plant design, operation, or the manner in which testing is performed, the consequences of accident scenarios postulated in the Final Safety Analysis Report will not increase.

Therefore, there would be no increase in the probability or consequences of an accident previously evaluated.

The proposed amendment does not create the possibility of a new or different kind of accident from any accident previously evaluated.

Therefore, the proposed change does not create the possibility of a new or different kind of accident from any accident previously evaluated.

The proposed amendment does not involve a significant reduction in the margin of safety.

The margin of safety is neither described or prescribed for this specification. The proposed change simply provides additional time to perform a surveillance and verify that the operability of equipment is in conformance with the Technical Specification requirements. Therefore, the proposed change does not involve a significant reduction in a margin of safety.

NPF-63 REQUEST FOR LICENSE AMENDMENT PERFORMANCE OF TECHNICAL,SPECIFICATION SURVEILLANCES ENVIRONMENTAL CONSIDERATIONS 10 CFR 51.22(c)(9) provides criterion for and identification of licensing and regulatory actions eligible for categorical exclusion from performing an environmental assessment. A proposed amendment to an operating license for a facility requires no environmental assessment if operation of the facility in accordance with the proposed amendment would not: (1) involve a significant hazards consideration; (2) result in a significant change in the types or significant increase in the amounts of any effluents that may be released offsite; (3) result in a significant increase in individual or cumulative occupational radiation exposure. Carolina Power & Light Company has reviewed this request and determined that the proposed amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9). Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment needs to be prepared in connection with the issuance of the amendment. The basis for this determination follows:
