J. Cernek UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 November 13, 2023 Honorable Juan Garza, Jr., Chairman Kickapoo Traditional Tribe of Texas 2212 Rosita Valley Road Eagle Pass, TX 78852

SUBJECT:

NOTICE OF AVAILABILITY OF THE DRAFT SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT FOR THE COMANCHE PEAK NUCLEAR POWER PLANT, UNITS 1 AND 2, LICENSE RENEWAL

Dear Chairman Juan Garza,

Jr.:

The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment the draft Supplement 60, License Renewal, to the Generic Environmental Impact Statement (GEIS) for License Renewal of Nuclear Plants, NUREG-1437, regarding the renewal of Facility Operating License Nos. NPF-87 and NPF-89 for an additional 20 years of operation for Comanche Peak Nuclear Power Plant (CPNPP), Units 1 and 2. The CPNPP facility is operated by Vistra Operations Company, LLC in Somervell County, Texas. The NRC staff initiated consultation with you regarding this project in April 2023. In accordance with Title 36 of the Code of Federal Regulations (36 CFR) 800.8(c), the NRC staff has elected to use the National Environmental Policy Act of 1969, as amended, process to comply with its obligations under Section 106 of the National Historic Preservation Act of 1966, as amended.

The draft Supplemental Environmental Impact Statement (DSEIS) includes the preliminary analysis that evaluates the environmental impacts of the proposed action and alternatives to the proposed action. For Category 1 issues, no additional site-specific analysis is required in the DSEIS unless new and significant information is identified. Site-specific issues (Category 2) are those that do not meet one or more of the criteria for Category 1 issues; therefore, an additional site-specific review for the non-generic issues is required, and the results are documented in the DSEIS. Together, the DSEIS and the GEIS evaluate, on a site-specific basis, all the environmental impacts of the proposed continued operation for a period of 20 years for CPNPP.

As discussed in the DSEIS, the NRC staffs preliminary recommendation is that the adverse environmental impacts of the license renewal are not so great that preserving the option for energy-planning decision-makers would be unreasonable. The NRC staff has concluded that the proposed action, LR, would not adversely affect known historic properties or historic and cultural resources. The DSEIS is available via the following link: CPNPP DEIS (ML23299A252).

The DSEIS may also be obtained online in the NRCs Agencywide Documents Access and Management System (ADAMS) Public Documents collection at https://www.nrc.gov/reading-rm/adams.html under ML23299A252. Pursuant to 36 CFR 800.8(c)(1)(iii) and 36 CFR 800.8(c)(2)(i), the NRC is requesting your comments on the DSEIS and preliminary recommendation by December 26, 2023. Electronic comments on the DSEIS may be submitted to the NRC by accessing, https://www.regulations.gov and searching for Docket ID NRC-2022-0183. Written comments should be submitted by mail to:
