REVISION OF SCHEDULE FOR THE SAFETY REVIEW OF THE COMANCHE PEAK NUCLEAR POWER PLANT, UNITS 1 AND 2, LICENSE RENEWAL APPLICATION (EPID NO. L 2022-RNW-0018) (DOCKET NUMBERS: 50-445 AND 50-446)

Dear Ken J. Peters:

By letter dated October 3, 2022 (Agencywide Documents Access and Management System (ADAMS) Package Accession No. ML22276A082), Vistra Operations Company LLC (Vistra or the applicant) submitted an application for license renewal of Facility Operating License Nos.

NPF-87 and NPF-89 for Comanche Peak Nuclear Power Plant (CPNPP), Units 1 and 2, to the U.S. Nuclear Regulatory Commission (NRC or staff), pursuant to Title 10 of the Code of Federal Regulations Part 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants.

By letter dated November 23, 2022 (ML22297A007), the staff concluded that the application was acceptable for docketing and included the staffs projected review schedule for the CPNPP license renewal application. By letter dated September 21, 2023 (ML23263A024), the staff issued a revised schedule to the environmental review of the CPNPP license renewal application.

The purpose of this letter is to inform you of changes in the safety review schedule for the CPNPP license renewal application, affecting the milestones for the Issue Safety Evaluation Report (SER), ACRS [Advisory Committee on Reactor Safeguards] Subcommittee Meeting, and ACRS Full Committee Meeting. Specifically, the Issue Safety Evaluation Report milestone will be revised from December 2023 to February 2024 to address an operating experience-related issue that was identified during the Inspection Procedure 71002, License Renewal Inspection, inspection, conducted September 11-15 and 25-19, 2023. The issue involved leakage in the spent fuel pool liner; therefore, its potential impact to the Structures Monitoring aging management program will need to be evaluated. Due to the timing of when this matter was identified, the milestone date to issue the staffs Safety Evaluation Report will be impacted. The revised date factors in the time that the applicant will need to review the

operating experience and its impact to its aging management activities, and the time that the staff will need to review any proposed changes.

For initial license renewal application reviews, both an ACRS Subcommittee and the Full Committee meetings are typically conducted in sequence. Based on discussions with the staff, the ACRS Committee has determined that, if a Safety Evaluation Report can be issued without open items, unresolved items, and confirmatory items, then only the Full Committee meeting would need to be conducted. Based on this determination, the ACRS Subcommittee Meeting milestone will be removed, and the ACRS Full Committee Meeting milestone will be revised from June 2024 to April 2024. If the staff decides to issue a Safety Evaluation Report with open items as a result of the staffs review of the operating experience-related issue noted above, then the license renewal review schedule will be revised to re-include the ACRS Subcommittee meeting.

The current milestone date to issue the renewed licenses for CPNPP Units 1 and 2 (September 2024) is not expected to be impacted by the changes described above.

The enclosure of this letter provides the staffs revised projected schedule for the CPNPP license renewal application review. The staff will strive to meet the milestones ahead of the revised schedule whenever feasible.
