SUMMARY

OF JUNE 6 AND JUNE 14, 2023, CLOSED MEETINGS WITH KAIROS POWER, LLC REGARDING CONSULTATIONS UNDER SECTION 106 OF THE NATIONAL HISTORIC PRESERVATION ACT On June 6 and June 14, 2023, a closed meeting was held via webinar between staff from the U.S. Nuclear Regulatory Commission (NRC) and representatives of Kairos Power, LLC (Kairos).

The purpose of this meeting was to discuss information protected under Section 304 of the National Historic Preservation Act (NHPA). A list of meeting attendees from each meeting is provided as an enclosure to this summary.

During the June 6 meeting, the staff shared with Kairos information discussed with the consulting Tribes Tribal Historic Preservation Officer (THPO) in meetings that were held on June 1 and 5, 2023. The purpose of the meetings with the THPO was to discuss the supplemental information submitted to the NRC by Kairos on April 20, 2023. NRC transmitted Kairos supplemental information to the consulting Tribe on April 28, 2023. The THPO gave preliminary feedback and stated that she would be providing her comments to the NRC in writing within a week. A public summary of the NRC staff and tribal discussions is included in the Agencywide Documents Access and Management System ML23173A008.

NRC staff stated that once they receive the consulting Tribes comments, the staff will relay the information to Kairos. NRC informed Kairos that it has scheduled weekly status meetings with the consulting Tribe to share pertinent information and ensure alignment to facilitate the timely completion of NHPA Section 106 consultation. The NRC staff informed Kairos that the THPO confirmed that the Tribe wants to keep consultation at a government-to-government level.

Based on the preliminary feedback from the THPO, NRC discussed the need for Kairos to have a geoarchaeologist appropriately qualified under Secretary of Interior (SOI) standards to review pertinent information related to the proposed project, develop a methodology for a reconnaissance field investigation, and update the draft monitoring plan, as appropriate. The NRC staff stated that this methodology should be made available to the NRC and consulting Tribe for review and comment. Consistent with the Tribes request for government-to-government consultation, the NRC will facilitate the discussion with the consulting Tribe and will provide information to Kairos.

Kairos staff agreed that in order to facilitate resolution of the NHPA consultations between NRC and the Tribe, they intend to utilize a geoarchaeologist, appropriately qualified under SOI standards pursuant to appendix A of 36 CFR part 61, to develop a methodology for a reconnaissance-level field investigation of the Hermes site and to make appropriate updates to the monitoring information. This documentation would be made available to the NRC and the

consulting Tribe for review and comment. Weekly closed meetings will continue to facilitate close coordination on future information submittals and support the path forward to conclude NHPA Section 106 consultation.

During the June 14 meeting, the staff informed Kairos that the NRC would be moving forward with the issuance of the final environmental impact statement (EIS) and that an agreement on the path forward from Kairos and the THPO would be needed to reference in the EIS. The staff informed Kairos that in a June 8 meeting with the THPO, a similar request had been expressed to the Tribe.
