SUMMARY
OF SEPTEMBER 12 AND SEPTEMBER 21, 2023, CLOSED MEETINGS WITH KAIROS POWER, LLC REGARDING CONSULTATIONS UNDER SECTION 106 OF THE NATIONAL HISTORIC PRESERVATION ACT On September 12, 2023, and September 21, 2023, closed meetings were held via webinar between staff from the U.S. Nuclear Regulatory Commission (NRC) and representatives of Kairos Power, LLC (Kairos). The purpose of both meetings was to discuss progress of activities supporting the NRCs consultations with a Federally Recognized Tribe under Section 106 of the National Historic Preservation Act (NHPA). The information discussed is protected under NHPA Section 304. A list of meeting attendees is provided as an enclosure to this summary.
During the September 12 meeting, the staff discussed the impending availability of Kairos report from their early August field investigation and of their updated Draft Archaeological Resource Monitoring and Unanticipated Discovery Plan (monitoring plan) for staff and consulting Tribe review. Kairos staff shared the highpoints from their report and monitoring plan and showed how staff observations and consulting Tribes feedback from earlier Kairos submittals were addressed in the report and monitoring plan. Additional discussions were held to address questions from both NRC staff and Kairos on the details of the documents.
The NRC staff then discussed their plan for a meeting with the consulting Tribes Tribal Historic Preservation Officer (THPO) on September 14. The staff discussed its goal to work with the THPO to set up regular calls for greater efficiency in the comment resolution process between the consulting Tribe and Kairos.
On September 13, Kairos provided to the NRC staff a link to their draft report and updated monitoring plan to facilitate communications with the THPO.
During the September 21 meeting, the NRC staff informed Kairos that the staffs review of the draft report and updated monitoring plan was ongoing and that as of September 21, there were no major concerns or questions. The staff informed Kairos that meetings with the THPO had been scheduled for September 26, October 5, and October 12 to allow for anticipated back and forth discussions as the tribe provides feedback on the report and updated monitoring plan.
The NRC staff informed Kairos that the staff had discussed with the THPO the anticipated process for consultation closure once all parties have agreed upon the monitoring plan. The NRC staff will prepare a letter summarizing the key points from the consultation that will include the updates planned for the Construction Permit Appendix A (Environmental Protection Plan) and the Record of Decision. The THPOs concurrence to the NRCs letter will complete consultations with the consulting Tribe. October 3, 2023 Kairos Power, LLC The staff also alerted Kairos of plans to discuss with the THPO a very rough timeline of future consultations on related undertakings at the Hermes site to facilitate future interactions and planning efforts.
