OF JUNE 29, 2023 AND JULY 25, 2023, CLOSED MEETINGS WITH KAIROS POWER, LLC REGARDING CONSULTATIONS UNDER SECTION 106 OF THE NATIONAL HISTORIC PRESERVATION ACT On June 29, 2023 and July 25, 2023, closed meetings were held via webinar between staff from the U.S. Nuclear Regulatory Commission (NRC) and representatives of Kairos Power, LLC (Kairos). The purpose of both meetings was to discuss progress of activities supporting the NRCs consultations with a Federally Recognized Tribe under Section 304106 of the National Historic Preservation Act (NHPA). The information discussed is protected under NHPA Section 304. A list of meeting attendees is provided as an enclosure to this summary.

During the June 29 meeting, the staff discussed the Tribal Historic Preservation Offices (THPOs) recent email agreeing that the Kairos letter dated June 23, 2023 (ML23178A096) accurately depicted the path forward for consultations. Kairos introduced the geoarchaeologist who will be developing the methodology for the reconnaissance field investigation and advising Kairos in the update to the Archaeological Monitoring and Discovery Plan. Kairos staff discussed the material that the geoarchaeologist was reviewing to prepare the plan for the fieldwork. Kairos staff stated that the methodology should be ready to share in a few weeks.

The plans for a late July site visit by management from the NRCs Division of Rulemaking, Environmental and Financial Support (REFS) was also discussed.

The focus of the July 25 meeting was to provide feedback to Kairos regarding their draft methodology for the field investigation that had been provided the prior week for staff and tribal review. In calls with the THPO on July 21 and 25, 2023, the THPO provided feedback to the NRC staff on the methodology which the staff shared with Kairos. Kairos replied that they would update their methodology to address those items and did not have any follow up questions for the NRC to take back to the tribe on those issues.

The staff provided additional observations regarding the methodology and key questions that could be answered as part of the field investigation. The geoarchaeologist retained by Kairos said that the staff observations were good suggestions to consider for the field investigation, the report from the field investigation, and any updates to the Archaeological Resource Monitoring and Unanticipated Discovery Plan.

The NRC staff also asked whether Kairos planned to consider Hermes 2 in the upcoming field investigation. Kairos stated that the Hermes 2 area will be part of the field investigation and the Hermes 2 activities will be covered in the monitoring plan.

August 31, 2023 In anticipation of the upcoming site visit by REFS management, Kairos shared the map that they would be adding to the field investigation methodology. Kairos and the staff discussed the 30 acres evaluated in the Hermes 1 area as the permanently disturbed area and how the Hermes 2 permanent disturbance will be generally encompassed in that same area.

As a follow-up, on August 2, the NRC staff informed Kairos that the consulting tribe THPO had concurred that the updated methodology for the field investigation had appropriately incorporated the tribal feedback.
