SUMMARY

OF APRIL 11, 2023, CLOSED MEETING WITH KAIROS POWER, LLC REGARDING CONSULTATIONS UNDER NATIONAL HISTORIC PRESERVATION ACT On April 11, 2023, a closed meeting was held via webinar between the U.S. Nuclear Regulatory Commission (NRC) staff, staff from the Pacific Northwest National Laboratory and representatives of Kairos Power, LLC (Kairos). The purpose of this meeting was to discuss information protected under Section 304 of the National Historic Preservation Act (NHPA). The meeting notice is available in the Agencywide Documents Access and Management System (ADAMS) ML3103A265. A list of meeting attendees is provided as an enclosure to this summary.

On December 6, 2022, the NRC received comments from a consulting Tribe on the Kairos Hermes Construction Permit Draft Environmental Impact Statement which recommended that a cultural resources survey be conducted for the proposed project. In its letter, the Tribe also informed NRC of its interest in acting as a consulting party and requested that the NRC include the Tribe in the development of the Archaeological Monitoring and Discovery Plan for the Kairos site (ML23031A036). The focus of the April 11th meeting was to discuss a submittal that Kairos is developing to support the NRCs ongoing consultations under NHPA Section 106 with the consulting Tribe, including relevant data analysis from existing soil samples and a draft version of the Archaeological Monitoring and Discovery Plan for the Kairos Hermes site. Kairos presented information from the submittal they are currently developing, following topics of interest provided earlier by the staff.

The NRC staff discussed potential concerns that the consulting Tribe might have regarding how the Kairos submittal would meet the reasonable and good faith identification standards in 36 CFR 800.4(b)(1). Representatives speaking on behalf of the Kairos submittal stated that they would include additional information in the submittal to address these concerns.
