Thank you for the notification on this project. The location of the project appears to be outside the Poarch Band of Creek Indians area of interest. We respectfully defer NHPA consultation to those Tribes with a stronger connection to the projects location.

Thanks again Larry D. Haikey, MS Tribal Historic Preservation Officer Poarch Band of Creek Indians 5811 Jack Springs Road Atmore, AL 36502 Phone: 251-368-9136 ext. 2072 Cell: 251-359-1110 From: Davis, Jennifer <Jennifer.Davis@nrc.gov>

Re: Kairos Power Hermes Non-Power Test Reactor Construction Permit Review The U.S. Nuclear Regulatory Commission (NRC) is conducting an environmental review for a construction permit application submitted by Kairos Power, LLC (Kairos) for the proposed Hermes non-power demonstration reactor. The facility, if licensed, would be constructed on a site within the East Tennessee Technology Park in Oak Ridge, Tennessee. The purpose of the attached letter is to initiate Section 106 consultation with your Tribe. The NRCs notice of intent to conduct scoping in regards to the Kairos application has been published in the Federal Register: 87 FR 9394. The comment period concludes on April 19, 2022.

Please contact me if you have any questions.

Sincerely, Jennifer A. Davis Senior Environmental Project Manager Division of Rulemaking, Environmental, and Financial Support Office of Nuclear Material Safety and Safeguards U.S. Nuclear Regulatory Commission (301) 415-3835
