Notice of Intent to Conduct Scoping Process and Prepare Environmental Impact Statement (EiS); Kairos Energy, LLC, Kairos Test Reactor

Dear Sir/Madam:

I am writing on behalf of the City of Oak Ridge, Tennessee in response to the Nuclear Regulatory Commissions (NRC) Federal Register Notice dated February 18, 2022 on the subject notice. I, along with several other city representatives, participated in the NRCs virtual public outreach and scoping meeting held on March 23, 2022. Oak Ridge Councilmember Ellen Smith and I both stated the communitys support for the proposed project; we applauded the opportunity to create new jobs and advance new, innovative technology in our town.

The Industrial Development Board of the City of Oak Ridge has been engaged with Kairos Power LLC for more than a year and has finalized a lease and Payment in Lieu of Tax (PILOT) agreement to facilitate the acquisition of property for the construction of Kaiross Hermes test reactor project. As City Manager, I spent many hours reviewing the companys plans and gave a favorable review in February 2021 of the PILOT request submitted by Kairos. Staff has also monitored and reviewed much of the supporting documentation regarding the NRCs process with Kairos that is available on the NRCs Agencywide Documents Access and Management System (ADAMS).

Several additional comments for consideration. First, as the NRC prepares an EIS to evaluate the environmental impacts for a construction permit (CP), please allow sufficient time for our city officials to review the document and to prepare comments for transmittal. Our City Council typically holds one business meeting monthly (2'^'^ Monday), so receiving lengthy and technical documents at least 45-60 days prior to the deadline is necessary. Second, the socioeconomic analyses should include the cumulative impact of several nuclear-related projects under consideration and review in Oak Ridge, including the Tennessee Valley Authoritys Clinch River Nuclear Site. For example, the City and Roane County governments will need input regarding Post Office Box 11 Oak Ridge, Tennessee 37831-0001

any safety zone requirements, as well as the effectively trained responses by regional public safety to the site over the next 13 years. Third, it is the Citys understanding that the 35MW demand test reactor will not produce electricity. However, it is important that the City understand the electric power and other infrastructure requirements needed for the projects construction and operation such as redundancy needs.

Finally, it is the Citys understanding that the Construction Permit, if issued, is the first step in the NRC process, to be followed by a second Operations Permit application process. We urge regular and effective communication with local officials that would complete the process in a timely manner, including planning for the NRCs in person meeting in Oak Ridge under consideration for later this year.
