POINT BEACH NUCLEAR PLANT, UNITS 1 AND 2 - DETERMINATION OF ACCEPTABILITY AND SUFFICIENCY FOR DOCKETING, PROPOSED REVIEW SCHEDULE, AND NOTICE OF OPPORTUNITY TO REQUEST A HEARING REGARDING THE NEXTERA ENERGY POINT BEACH, LLC APPLICATION FOR SUBSEQUENT LICENSE RENEWAL (EPID NO. L-2020-SLR-0002)

Dear Mr. Moul:

By letter dated November 16, 2020 (Agencywide Documents Access and Management System (ADAMS) Package Accession No. ML20329A292), NextEra Energy Point Beach, LLC (NextEra) submitted an application for subsequent renewal of Renewed Facility Operating License Nos. DPR-24 and DPR-27 for Point Beach Nuclear Plant, Units 1 and 2 (Point Beach),

respectively, to the U.S. Nuclear Regulatory Commission (NRC).

By letter dated December 22, 2020 (ADAMS Accession No. ML20328A075) and Federal Register Notice (FRN) dated December 29, 2020 (85 FR 85685), the NRC informed NextEra and the public of the receipt and availability of this application.

The NRC staff reviewed the application following the guidance in NUREG-2192, Standard Review Plan for Review of Subsequent License Renewal Applications for Nuclear Power Plants (ADAMS Accession No. ML17188A158), and NUREG-1555, Supplement 1, Revision 1, Standard Review Plans for Environmental Reviews for Nuclear Power Plants (ADAMS Accession No. ML13106A246), to determine if the application conforms to the timing and information requirements, is reasonably complete, and is acceptable for docketing in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Sections 2.101, 51.45, 51.53(c), 54.19, 54.21, 54.22, and 54.23.

The NRC staff made the following observations while performing its acceptance review of the application:

  • NextEra has not provided a Clean Water Act (CWA) Section 401 Water Quality Certification (WQC) from the Wisconsin Department of Natural Resources (the CWA 401 Certifying Authority), or a documented waiver or other documentation from the Certifying Authority that Section 401

D. Moul Certification does not apply to the subsequent renewal of the licenses for Point Beach. The staff cannot issue the subsequent renewed licenses without this certification or documented waiver from the Certifying Authority. As such, the lack of Section 401 certification has the potential to adversely impact the issuance of the subsequent renewed licenses.

  • NextEra has not provided a Coastal Zone Management Act (CZMA) consistency certification determination from the State of Wisconsin that subsequent license renewal will be compliant with the enforceable provisions of the State coastal zone program. The staff cannot issue the subsequent renewed licenses without this certification. As such, the lack of CZMA certification has the potential to adversely impact the issuance of the subsequent renewed licenses.

As stated in the email sent to Mr. Maher on January 8, 2021 (ADAMS Accession No. ML21012A365), the NRC staff determined that the application is acceptable for docketing and that the staff will proceed with its detailed technical review. Given the lesser scope and depth of the acceptance review as compared to the NRC staffs detailed technical review, the staffs acceptance review determination does not preclude future requests for additional information (RAIs) or topic-specific audits during the NRC staffs detailed technical review. Also, there may be other instances where issues that impact the NRC staffs ability to complete the detailed technical review are identified. You will be advised of any further information needed to support the NRC staffs detailed technical review by separate correspondence.

This letter also forwards the NRC staffs projected review schedule for the Point Beach subsequent license renewal application (Enclosure 1). The NRC staff will follow established review procedures and the enclosed schedule to complete the reviews required by 10 CFR Parts 51 and 54. Based on the information provided in the submittal and discussions during pre-application meetings, the NRC staff estimates that the review of this subsequent license renewal application will take approximately 23,000 hours0 days <br />0 hours <br />0 weeks <br />0 months <br /> to complete. If there are emergent complexities or challenges in the NRC staffs detailed technical review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated via separate correspondence. Milestones for adjudicatory hearing activities that may be needed are not included in the enclosed schedule or the estimated hours because those dates would be established by the Commission or an Atomic Safety and Licensing Board, and hearing-related resource considerations, if any, would need to be developed in the future.

The NRC staffs review schedule also relies on the assumption that the NextEra responses to any staff RAIs will be of high quality and provided in a timely manner. A timely response is defined as 30 days from the date of the request, or within such other time as may be specified in the request in accordance with 10 CFR 2.108. NextEra should also be prepared to provide high quality support in a timely and organized manner during any technical audits that are determined to be necessary by the NRC staff. Please inform the NRC staff in writing as early as possible should potential delays arise in NextEras support of the review schedule.

The NRC staff notes that the application covers the subsequent license renewal period for which new plant-specific analyses have been provided and plant-specific supplements to topical reports have been referenced, which have not yet been reviewed by the staff. The NRC staff may require the expenditure of additional effort, including potential additional audits, to complete the review of plant-specific analyses or topical reports referenced in the application on a plant-

D. Moul specific basis. The NRC staffs goal is to complete the review in 18 months provided that NextEra fully addresses the staffs information needs in a timely manner.

Also enclosed for your information is a copy of the notice of the acceptance of the application for review and of an opportunity to request a hearing and to petition for leave to intervene that is being sent to the Office of the Federal Register for publication (Enclosure 2).
