Dear Dr. Guo:

By letter dated September 18, 2020 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20311A106), you provided a request to amend Special Nuclear Material License (SNM) SNM-95 to remove a laboratory from the license as an authorized space to store and use specific materials on the license. Room 9 is a laboratory in the Hammond Building that has been one of the spaces authorized for the safe use of SNM at the University Park Campus of the Pennsylvania State University (PSU). The PSU is planning to release the site for unrestricted use. This amendment addresses the removal of materials and decommissioning of the laboratory from SNM use licensed by the U.S. Nuclear Regulatory Commission (NRC).

Your request included a detailed description of the history and use of the laboratory, which was authorized for SNM use in Amendment 5 to the license by letter dated September 18, 2014 (ADAMS Accession No. ML14114A300). Your request to amend SNM-95 and remove authorization for use of Room 9 in the Hammond Building is hereby approved. Condition S-1 is modified to incorporate, by reference, the letter of September 18, 2020. Condition S-2 was modified to remove reference to material use in Room 9 of the Hammond Building. All other conditions of the license remain the same. Enclosed is a copy of the amended SNM License SNM-95 and the Safety Evaluation Report.

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. Enclosure 3 will not be publicly available. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
