VT Interest in NRC's Handling of H&l Aspect of VY AOG Allegation RA,01:

l l received a call today from Bill Sherman, State Nuclear Engineer, VT Department of Public l Safety. During that call, Sherman indicated that VT DPS may soon be less than satisfied with -

. NRC's handllng of an allegation of H&l regarding work to be performed on the VY AOG ,

system. j Specifically: l

..1) DPS feels that NRC shnuld respond rapidly and independently to the H&l issue to assure l

' that there was no obvious discrimination involved. j

- 2) Sherman also indicated that the NRC was made aware of this issue in late December 1995

and, although we have told him that we plan to refer this to the licensee, we have not yet sent

- the official referralletter. Sherman expressed cor,cem regarding the timeliness of that transmittal.

Sherman indicated that if the State is not satisfied, with NRC's approach, they were prepared to escalate the issue. The Govemor and DPS Commissioner Rich Sedano may get involved at i this point. I expect that this may begin next week. l This escalation appears to be fast breaking. I was introduced to this yesterday and, at Sherman's request, forwarded the concem to Rich Conte at that time. Rich provided an  ;

update to Sherman later yesterday. If intamal pressures exist within the State to bring this to j

' resolution, other than that Sedano, McCandless (VT Health) and others were mentioned in ti,a newspaper article, I am not aware of the details of those pressures.
