ATTEMPTS TO INTERVIEW VY ENGINEER CONNECTED WITH INSPECTION This memo is written to document my attempts to interview E. J. Massey of the Vermont Yankee organization during the perfor ance of my duties as an NRC inspector.

The inspection was for the Vermont Yankee Advanced Off-Gas (A0G) System, which was conducted on-site from March 3 - 8 1996. Mr. Massey was the project engineer for EDCR 94-402. which was part of my scope. He was not available when I needed to interview him on March 8. 1996. I found out that he was on sick leave that day and that he returned to work on March 12, 1996. I phoned him from my Region I office on March 13, 1996 and he stated that he "did not write the allegation." and told me that his lawyer advised him to talk to me in his presence. He also told me that R. A. Matakus of OI had contacted him and wanted to know if I could arrange to hold my interview during the same day as Mr. Matakus. I told Mr. Massey that my questions would involve only the technical aspects of the A0G On March 14. 1996. I went to your office and told you the background as to why I needed to talk to Mr. Massey. You contacted Mr. Matakus by leaving a phone message. I met with Mr. Matakus who aid that he had been in contact with Mr.

Massey's lawyer. Mr. David Gibson (phone 802-254-6011) and had explained to Mr. Gibson that I was only interested in the technical side of the A0G system.

My recollection was that Mr. Matakus had set up an 0I meeting with Mr. Gibson, but the timing of the meeting did not meet the needs of my inspection report feeder deadline.

I then went to you on March 14, 1996. You called Mr. Gibson in my presence.

I told Mr. Gibson that I was only involved with the technical side and that I had a re) ort deadline of March 15. 1996, thct Friday. Mr. Gibson was going to talk witi Mr. Massey and call either you or me that afternoon. Mr Gibson did not call back that afternoon.

I called and tried to talk with Mr. Gibson on three occasions on March 15.

1996. but his secretary said that he was either with a client or not available. Mr. Gibson finally called me at 5:20 pm and told me that he would talk to his client over the weekend to see if he would talk to me by telecon.

Mr. Gibson said that he would call me on Monday. March 18. 1996.

On March 18. 1996. I called Mr. Gibson's office three times and was told Mr.

Gibson would call me. Finally, at four o' clock. I was told that Mr. Gibcon went to court. I left a message that my four o' clock phone call was ti last time that I would call to try and catch Mr. Gibson when he was availat.

I then went to your office and told you that I would not try and call bc .

Gibson anymore. My reason was that I must get my inspection report feeder out, and that I spent enough time trying to obtain an interview with Mr.

Massey.
