SUBJECT:
PROPOSED RULE ON REVISIONS TO'10 CFR PART 72 ENTITLED,
" STORAGE OF SPENT NUCLEAR FUEL IN NRC-APPROVED STORAGE CASKS-l AT NUCLEAR POWER REACTOR SITES" Enclosed for your consideration is a. Commission paper concerning proposed rulemaking that would revise 10 CFR Part 72_to allow power reactor licensees to store spent fuel under a general _ license at reactor sites. The spent fuel would have to be' stored in dry casks approved by the NRC. The proposed rule would also set forth procedures and criteria for obtaining approval of cask 4
designs. Amendments to 10 CFR Part 170 are also being added to ensure that full costs would be recovered for review and approval and inspection services i
that would be rendered by the NRC staff under requirements of the rule. At the request of OGC, 'a minor editorial change to 972.30, " Decommissioning planning, including financing and recordkeeping", is being added to make clear that a decommissioning funding plan is an integral part of an applicant's proposed decommissioning plan.
Nuclear Waste (ACNW) posed rule was reviewed by the Advisory Comittee on
Background:
The pro at a meeting held.on Tuesday, June 28, 1988. The Advisory Comittee on Reactor Safeguards had been informed of this action, but deferred review of the proposed rule to the ACNW. Revisions were made to the draft reviewed by the ACNW in response to coments contained in a memorandum addressed.to Chairman Lando W. Zech, Jr. dated July 1,1988. The proposed rule was reviewed by the Comittee to Review Generic Requirements (CRGR) on Wednesday, November 9,1988.
The CRGR requested a second meeting to review the contents of the spent fuel storage cask Certificate of Compliance and regulatory guides 3.61 and 3.62.
This meeting was held on Wednesday, December 14, 1988.
Revisions were made as a result of coments received from the CRGR, Notices: The appropriate Congressional Comittees will be informed by letter.
The comission paper recomends that the proposed rule be published in the Federal Register with a 45-day coment period.
Backfit Analysis: The Staff has determined that a backfit analysis is not required, because these amendments do not involve any provisions that would imposebackfitsasdefinedin10CFR50.109(a)(1).

STORAGE CASKS AT NUCLEAR POWER REACTOR SITES The Office of' Administration and Resources' Management concurs, subject to the comments provided, in the proposed rule that.would amend 10 CFR Part 72. to provide for the storage of spent ' fuel at -
nuclear powercreactor sites without the need for additional' site-specific _ approvals.
We have enclosed a marked-up copy of the proposed' rule that' presents a number of editorial corrections.
The proposed rule contains information collection requirements ~
that must bel. approved by the Office of Management and Budget (OMB).
The clearance package requesting OMB review and approval of:these information collection requirements must be forwarded to OMB before the proposed rule may be submitted for signature and i
publication in the. Federal Register.
In addition, OMB published an, amendment to its regulations implementing the Paperwork Reduction Act on May.10, 1988.
This amendment requires each agency to. provide added information in the Paperwork Reduction Act
. Statement that appears in rulemaking documents containing new or amended.information collection requirements.
We have' enclosed the correct language for insertion in this proposed rule as part of l
our. mark-up.
Preparation of the clearance package and completion of the added language should be coordinated with t he Records and Reports Management Branch, Division of Information Support Services, ARM.
The proposed rule contains conforming. amendments to 10 CFR Part 170 concerning the establishment and revision of categories and
. fees.
The proposed. amendments to 10 CFR 170.31 and 170.32 must be coordinated with the License Fee Management Branch, Division of Accounting and Finance, ARM to resolve any remaining issues concerning the organization and content of those provisions.
