NRR CONSIDERATION OF THE RES PROPOSED COMMISSION PAPER Pearson FORWARDING A RULEMAKING ENTITLED " STORAGE OF SPENT FUEL File, pt IN NRC-APPROVED STORAGE CASKS AT NUCLEAR POWER REACTOR SITES" AND CONFORMING AMENDMENTS TO 10 CFR PART 72 AND 170 NRR has no technical objection to the proposal but NRR responsibilities for implementing the rule are incorrectly stated in the Commission paper. NRR responsibilities concerning this matter are explained in the Memorandum of j
Understanding (MOV) between NRR and NMSS.
A copy of the MOU has been forwarded to Bill Pearson of your staff. While not a direct NRR responsibility the rule appears inconsistent with Commission and ED0 guidance relative to the i

compatibility of storage casks with transportation applications.
Please note that negotiated modification-of the MOV could be necessary to reflect changes in the subject proposal.
