REQUEST FOR REVIEW 0F PROPOSED RULEMAKING ENTITLED, " STORAGE OF, SPENT NUCLEAR FUEL IN NRC APPROVED STORAGE CASKS AT CIVILIAN NUCLEAR POWER REACTOR SITES" This is in response to your memorandum of March 1,1988, requesting review of the draft proposed rulemaking on spent fuel storage cask certification. My staff has been working on a continuing basis with yours on this action. Also,.

there has been significant interaction with NMSS/SG, NRR and, in particular, 0GC staff. As a result, the draft proposed rule continues to be restructured.

At 'the most recent meeting with your staff and OGC staff, led by J. Scinto and R. Fonner, significant changes were proposed by OGC staff.

Your staff is incorporating these into the rule. Complementary changes to 10 CFR Part 73 are also being resolved between NMSS/SG and NRR.

With changes still continuing, I cannot concur on the proposed rulemaking yet.

I believe, however, that we are close to resolution. As soon as OGC's recommendations can be satisfactorily included and Part'73 issues resolved, I shall be happy to concur.

Let me say that I appreciate the excellent job of coordination with the Offices concerned and the hard work your staff is doing to make this a successful rulemaking.
