SUBJECT:

REVIEW OF REQUEST FOR RULEMAKING ON DRY STORAGE OF SPENT FUEL This is in response to your memorandum of March 1, 1988 requesting comments on the above matter. This office has briefly reviewed your proposal and suggest:

1. A provision for enforcement be added similar to other parts,
2. A definition be provided for the term " civilian nuclear power reactors."
3. The table of authority be amended to assure that each provision for which enforcement action is desirable is issued under either 161b, 1, or o.
4. Consideration should be given to amending the supplements of 10 CFR Part 2, Appendix C to provide examples to reflect this rule change.
5. Page 8 of Enclosure 1 should read " Carolina Power and Light" not " South Carolina..." and on page 14 of the enclosure the area code should be changed to 301.
