.t On July 30, 1985, Ron TOLSON, the former TUGC0 QC Supervisor at the Comanche 5
Peak Steam Electric Station (CPSES), was interviewed by NRC Investigator 4
H. Brooks Griffira in Dallas, Texas. TOLSON said he had been employed by TUGC0 g
from October 1974 until February 1985.
4 TOLSON confirmed that he had been interviewed regar' ding the withholding of the t
1978 MAC report by Robert WOOLDRIDGE, an attorney retained by TUGCO. TOLSON h
confirmed that WOOLDRIDGE's characterization of his testimony contained-in
.1 paragraph 3 of the second page of the utility's June 12,1985, letter was essentially accurate. TOLSON said that at the time the interver.or's interrog-atories were received by the utility in 1980, it had been and still was his opinion that the MAC report was producible under this request. TOLSON said he did not recall discussing this matter with Louis FIKAR. TOLSON said he recalled E
discussing the producibility of the MAC report with David CHAPMAN on several occasions. TOLSON said he did not know whether CHAPMAN believed the report should be produced and did not care to speculate on CHAPMAN's position regarding W
whether it was producible. TOLSON said he believed the intervenor's request

was broad enough in scope to include this report,

believed should be included in the response. TOLSON said he did not specifi-c..
cally recall who asked him to make the list but said he suspected it probably j

weeks after he was asked to produce the list, he heard a rumor that someone above CHAPMAN (not further identified) had determined that this 1978 MAC report N
was proprietary and would not be produced. TOLSON said he was on distribution i
for the response for the intervenor, so he was aware at that time that the MAC
'l report had not been incl.uded in the applicant's response.
fd TOLSON said that several years later when he was c'alled as a witness to appear lj before the CPSES ASLB he recalled confiding in CHAPMAN that if somebody asked q
him the right question, he would be forced to give his opinion that the MAC y
report had been producible under the intervenor's original request. TOLSON said H
that he was not asked about any other documents he thought might be producible
!1 under the intervenor's 1980 request, and said he did not testify about the report.
14 When TOLSON wds questioned about his opinion of the substance of the MAC report, j
he said he was disappointed by the fact that he believed MAC had questioned utility representatives about improvements that could be made in the QA program and subsequently adopted these reconnendations as their own and offered them as conclusions in their report. TOLSON confirued that he had participated in the internal response to the MAC report.
TOLSON said that while MAC was conducting their audit on site, he remembered

en organizational structure of QA. TOLSON said he did not recall being involved in any post audit meetings on site or in the TUGC0 corporate office.. When
%l, TOLSON was questioned about any possible conversations he may have had with any other TUGC0 representatives regarding the decision to withhold the MAC report, he said he recalled discussing it on several occasions with CHAPMAN and said he

may have discussed it with Susan PALMER (TUGC0 Senior Auditor). TOLSQN said he q
had no recollection of talking to Louis FIKAR or William CLEMENTS about the proprietary status of the MAC report.
TOLSON was also questioned about his knowledge of MAC audits of the Brown and Root QA program in 1977, 1978, and 1979. TOLSON said he had no recollection of MAC having performed any audits on site other than the 1978 TUGC0 audit.
