DISPOSITION OF RYE CONTENT 17N 2 Now come the Applicants and pursuant to 10 CFR 2.749, on the basis of the facts set forth in the " Affidavit of Richard H.
Strome (Rye No.2)" and for the reasons set forth below, hereby move the Board to issue an order granting summary disposition of Rye Contention No. 2 in favor of the Applicants.
REASONS FOR GRANTING THE MOTION The Board earlier denied a motion for summary disposition of this contention which motion was based on the assertion that a plan for the Rannie Webster Nursing Home, the focus of the contention, was being developed.- ASLB Mem. &

As can be seen from the accompanying affidavit of Richard H.
- Strome, the plan of concern is in the NHRERP under the title " Webster at Rye" the actual name of the facility of concern.

4 STATEMENT OF MATERIAL FACTS AS TO WHICH THERE IS NO DISPUTE 1.
Revision of-the New Hampshire Radiological Emergency Response Plan-(NHRERP), Volume 20 (Town of. Rye RERP) contains the Webster at Rye RERP, dated August, 1986, in Appendix F.
2.
The parenthetical reference for the Webster at Rye Plan stating " plan is currently being developed" will be deleted from the Appendix F index.
