. - NOTICE OF VIOLATION i

. United States Enrichment Corporation . Docket No. 70-7002' Portsmouth Gaseous Diffusion Plant - Certificate No. GDP 2 7 During an NRC inspection conducted from Decemb 15,1997, to January 25,1998, two ,

violations of NRC requirements were identified, in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violations are listed - ,

below; 4

. 1. Technical Safety Requirement 3.11.2 requires, in part, that all operations involving

' uranium enriched to 1.0 weight-percent (wt%) or higher U 235 and 15 grams (g) or more of U 235 shall be performed in accordance with a documented nuclear criticality safety  ;

. approval (NCSA).
e. NCSA-PLANT 018.A01, " Dry Active Waste (DAW) in Waste Generation Areas and in Interim Storage," requires that DAW containers with a capacity of SS gallons or

less be spaced at least two feet edge-to-edge from uranium bearing material.

L On January 15,1996, the NRC inspectors identified that DAW bags located in X 344 Building storage area were spaced less than two feet of 1S sample 4 cylinders containing uranium bearing material.

b. NCSA PLANT 057.001,"Use of Gas Sampling Cart," requires that a minimum two foot edge to edge spacing be maintained between the sampling cart and other uranium bearing material.

On January 23,1998, plant staff discovered that two gas sampling carta containing uranium bearing material were spaced less than two feet from each other in the X 333 Building.

i- c. NCSA-PLANT 48.A00," Contaminated Metal," requires a two foot edge to edge spacing horizontal and vertical to other contaminated items (uranium bearing material).

-1. On December 31,1997, plant staff discovered two buckets containing contaminated valve intemals were spaced less than two feet from each other,

, ' 2. On January 15,- 1998, plant staff discovered that begged valve subassemblies were spaced less than two feet from AG-17 valve in the X 326 Building.

~ d. NCSA PLANT 66.A02, " Mop Buckets," requires passive design features, i.e., slots

. and holes, in the sides of the bucket for volume control.

On January 15,1998, plant staff discovered an upright, empty mop bucket in a

posted contamination area (uranium bearing material area) in the X-344 Ruilding without the required passive design features.

Notice of Violation 2 Contrary to the above, between De: ember 31,1997 and January 15,1998, the certificatee failed to implement nuclear criticality safety controls as described by the aforementioned examples.

This is a Severity LevelIV violation (supplement VI). (VIO 70 7002/97015 01) 2.. Technical Safety Reaulrament (TSR) 2.5.3.4 requires, in part, that the affected cylinder and withdrawal manifold be isciated within 15-minutes after declaring both smoke detectors for a withdrawal position inoperable.

Contrary to the above, on December 15,1997, the certificatee did not isolate the withdrawal manifold at Extended Range Product Station No.1 within 15 minutes after (teclaring the station inoperable for surveillance testing of the smoke detection system.

This is a Severity Level IV violation (Supplement VI). (VIO 70 7002/97015 02)

Pursuant to the provisions of 10 CFR 76.70, United States Enrichment Corporation is hereby required to submit a written staternent or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region 111, and a copy to the NRC Resident inspector at the Portsmouth Gaseous Diff" Von Plant of this Notice, within 30 days of the date of the letter transmitting this Notice of Viowun (Notice). This reply should be clearly marked as a *Rept/ to a Notice of Violation" and should include for each violation: (1) the reason for the vlotation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achievec, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved, if you contest this enforcement action, you should also provide a copy of your response to the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, D.C. 20555-0001.

Your response may reference or inci'Jde previously docketed correspondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the responte time.
