NOTICE OF VIOLATION United States Enrichment Corporation Docket No. 70-7002 Portsmouth Gaseous Diffusion Plant- Certificate No. GDP-2 During an NRC inspection conducted from June 1-5,1998, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

Technical Safety Requirement 3.9.1, requires, in part, that written procedures shall be implemented for activities described in Appendix A of Safety Analysis Report, Section 6.11,

" Procedures." Appendix A of Section 6.11, describes training as an activity that shall be implemented in accordance with written procedures.

Procedure UE2-TR-TR1030, " Conduct of Training," Revision 0, Change B, dated July 31, ,1997, requires, in part, that organization / group managers place work restriction on employees where training is deficient. Procedure XP2-SF-SF1031," Administration of Emergency Squad,"

Revision 0, dated October 16,1996, requires, in part, emergency squad members successfully pass self-contained breathing apparatus training.

Contrary to the above, between February 1,1998 and June 3,1998, the organization / group managers failed to place work restrictions on 30 emergency squad members whose training was deficient in that they did not pass self-contained breathing apparatus training.

This is a Severity Level IV violation (Supplement VI). (VIO 70-7002/98010-01)

The NRC has concluded that information regarding the reason for the violation, the corrective i

actions taken and planned to correct the violation and prevent recurrence and the date when full compliance will be achieved is already adequately addressed on the docket in United States Enrichment Corporation's correspondence to the NRC dated January 5,1998 (GDP-98-2001).

However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position.

'In that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN:- Document Control Desk, Washington,- D.C. 20555 with a copy to the Regional Administrator, Region lil, and a copy to the NRC Resident Inspector at the Portsmouth Gaseous Diffusion Plant of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation.

If you contest this enforcement action, you should also provide a copy of your response to the Director, Office of Enforcement, U.S. Nuclear Regulatory Commission, Washington, D.C. 20555-0001.

L If you choose to respond, your response will be placed in the NRC Public Document Room l (PDR); therefore, to the extent possible, it should not include any personal, privacy, proprietary, l- or safeguards information so that it can be placed in the PDR without redaction. Under the authority of Section 182 of Act 42 U.S.C. 2232, any response shall be submitted under oath or j, affirmation.
