NOTICE OF VIOLATION 4

United States Enrichment Corporation Docket No. 70 7002 Portsmouth Gaseous Diffusion Plant Certificate No. GDP 2

' During an NRC inspection conducted from June 30.1997, to August 10,1997, two violations of NRC requirements were identified, in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the 4

violations are listed below:

1. Technical Safety Requirement (TSR) 3.11.2 requires, in part, that all operations 4

involving uranium enriched to 1.0 weight percent (wt%) or higher U 235 and 15 grams (g) or more of U 235 shall be performed in accordance with a documented nuclear criticality safety approval.

Contrary to the above, from June 27 to July 15, '1997, a cascade compressor in

, the X 333 building with deposits of uranium enriched to 1.0 wt% or higher U 235 and 15 g or more of U 235 was not stored in accordance with t. documented l nuclear criticality safety approval.

This is a Severity Level IV violation (Supplement VI). (VIO 70 7002/97005 01)

2. TSR 3.9.1 requires that written procedures be prepared, reviewed, approved, implemented, and maintained to cover activities described in SAR (Safety Analysis
Report) Section 6.11.4.1.

SAR_Section 6.11.4.1 requires that maintenance activities be addressed by written procedures, documented work instructions, or drawings appropriate to the circumstances as described in Section 2.5 of the Quality Assurance Program (OAP).

Section 2.5.3 of the QAP delineates examples of activities (otherwise known as

" skill-of the craft") which do not require step by step written procedures,

4 Notice of Violation 2-Pursuant to the provisions of 10 CFR 2.201, United States F.nrichment Corporation is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, O.C. 20555 with a copy to the Regional Administrator, Region Ill, and a copy to the NRC Resident inspector at the Portsmouth Gaseous Diffusion Plant of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and ths results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

Your response may reference or include previously docketed correspondence,if the correspondence adequately addresses the required response, if an adequate reply is not received within the time specified in this Notics, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may bo proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.

Because your response will be placed in the NRC Public Document Room (PDR), to the i

ntent possible, it should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.
