l An alleger from RI-97-A-0145 ca!!ed to indicate that he rec'd our letter. He questioned our basis for closure regarding management's culpability in regards to knowing that the alarm tests were not being preformed, but informed the NRC at a predecisional enforcement conference otherwise.
I told the alleger that we did not have conclusive evidence to support that claim. In addition, we noted that during l
our interviews and reviews of this matter, that individual defined management differently. The NRC views management as the George Jones level - not at the first line supervisor. The alleger asked where was Jon Edwards.
In addition the alleger questioned why we did not address the ESS transformer issue in the second to last paragraph in our letter (regarding management's culpability). I told the alleger that I would find out and call him back, but that I needed to check with the residents (DRP).
Don Florek told me (1) Jon Edwards is not considered management and (2) that in the inspection report, it was reasonable to conclude that the ESS transformer alarm tests were done and that the NRC did not find a problem with this matter.
I called the alleger back and provided him with the above information. The alleger said that we,sre not correct. The alleger said that Keith Davis specifically told Jon Edwards and Kevin Chambliss that the ESS transformer tests viere not done. I again articulated that the NRC does not have evidence to substantiated this matter. I asked the alleger if he was there when Keith Davis informed Jon Edwards. He replied, No. The alleger asked if I thought Keith Davis was lying. I said, I didn't say that. The alleger said that Mr. Davis has been very cooperative with the NRC. I again denied everything in regards to that statement.
I told the alleger that over the last two years, the NRC identified that communications was a very big problem and that the missed alarm tests were widespread and that this was not isolated to one grcup of people (i.e., NPCs). I also said that we brought this issue to PP&L management's attention (after the enforcement conference), they instituted corrective actions, and that we have been monitoring those corrective actions. In addition, there is an ongoing investigation. The NRC has not dropped the ball. I asked the alleger if he had any evidence to indicate that s'4fety tests were not being done today. He replied No.
The alleger was not happy. He believes that the NRC is in cahoots with PP&L NOTE: 01 plans to interview Mr. Davis and this matter can be addressed. However, Mr. Davis has not been very receptive to Ol's attempts to schedule an interview.
