, Specifications. The letter requested comments on the draft SE I

-and also requested that the licensee propose appropriate license conditions for the relocated material from the current technical specifications and for the scheduling of new more restrictive requirements. Finally, the letter requested a certified copy of the proposed Technical Specifications and Bases. By letter dated .

September 8, 1998, Duke Energy L.avided comments to the draft SE along with proposed license conditions, and certified TS and Bases as requested.

Based on conversations with the NRC staff and Duke'n internal review, additional information is provided concerning the draft SE. Enclosure 1 of this letter provides a revision to the proposed license condition as requested to address the scheduling of new or revised surveillance requirements. Enclosure 2 of this letter provides the changes necessary to the ITS submittal, as amended. to resolve items identified by Duke Energy during the review.

The proposed changes are administrative in nature and have been determined to be within the scope of the original PORC and NSRB reviews.

4 PROPOSED LICENSE CONDrflONS Section 2.C (2) of the Facility Operating License, NPF-9 and NPF-17, should be revised to include the following additional subparagraph:

For Surveillance Requirements (SRs) that are new in Amendment [ ] to Facility Operating License NPF-9 (NPF-17 for Unit 2}, the first performance is due at the end of the first surveillance interval that begins at implementation of Amendment [ ' j. For SRs that existed prior to Amendment [ ], including SRs with modified acceptance criteria and SRs whose intervals of performance is being extended, the first performance is due at

. the end of the first surveillance interval that begins on the date the Surveillance was last performed prior to implementation of Amendment [ ]. For SRs that existed prior to Amendment [ ], whose intervals of performance are being reduced, the first reduced surveillance interval begins upon completion of the first surveillance performed after implementation of Amendment [ J.

Add the following to section 2.C of the Facility Operating License, NPF-9 and NPF-17.

(13) Additional Conditions The Additional Conditions contained in Appendix C ( Appendix D, Unit 2}, as revised through Amendment [ ], are hereby incorporated into this license. Duke Energy Corporation shall operate the facility in accordance with the Additional Conditions.

Add Appendix C ( Appendix D, Unit 2) to the Facility Operating License, NPF-9 and NPF-17, to include the following:
