Dear Dr. Bartolome:
I am pleased to extend this official invitation to Mr. Edi1berto Cabalfin to be temporarily assigned to the staff of the United States Nuclear Regulatory Comission, Division of Site and Environmental Analysis, for a six-month period beginning May 1980. Mr. Cabalfin, an employee of PAEC, will be assigned to the Radiological Assessment Branch, where he will gain experience as a radiological specialist.
Please let us know as soon as possible the exact date we may expect Mr. Cabalfin.
He should call Dr. Joseph D. Lafleur Jr., (301) 492-7131, for any information or assistance he needs prior to reporting to Bethesda.
In addition to the extension of this invitation, I would like this letter, upon your countersignatures, to serve as' a memorandum of the following understandings:
- 1. Mr. Cabalfin will engage in activities essentially similar to those engaged in by USNRC employees, without any special " diverse experience" assignments except those that might be convenient to the USNRC.
- 2. All salary, allowances and travel costs for Mr. Cabalfin will be assumed by the Philippine Atomic Energy Commission and the International Atomic Energy Agency.
- 3. The assignment will be for a period of six months. However, by mutual consent of the signatnrs to this memorandum, this assignment mAy be -
terminated prior to the expiration of such period or may be extended for an additional period.
- 4. The Philippine Atomic Energy Commission (PAEC) affirms that Mr. Cabalfin is a permanent employee of its safety organization and will retain the -
employment relationship during his assignment to USNRC, and recomends him for his outstanding capability.
- 5. Mr. Cabalfin is capable of speaking, reading, and writing English fluently.
- 6. Mr. Cabalfin shall observe all rules, regulations and requirements of the USNRC including but not limited to security, safety, health, hours of work and conduct.

- 7. In his activities during this assignment, Mr. Cabalfin may encounter information furnished to the USNRC in confidence. Upon starting activities at USNRC, he will sign the enclosed statement (Annex 1) agreeing not to reproduce or remove any proprietary documents from their proper place of use and storage, and agreeing not to disclose such information or in any other way violate the conditions under which USNRC receives and uses proprietary infomation. Mr. Cabalfin
. will not be assigned to any activities involving access to classified infomation; to information on sensitive parts of the fuel cycle, such as reprocessing and enrichment technology; or to unclassified naval nuclear propulsion information.. All signators will be provided signed copies of this memorandum.
- 8. Annex 2 describes the assignment of patents rights for patents resulting from this assignment.
- 9. Annex 3 is the proposed Security Plan for Mr. Cabalfin.
- 10. The liability of the USNRC for injury to Mr. Cabalfin or damage to his property, the liability of Mr. Cabalfin and the PAEC to the USNRC for damage to its property, and the liability of Mr. Cabalfin and the PAEC to third parties for personal injury or property damage will be governed by the applicable law of the United States and the laws of the several States. The laws of the States are not unifom, but in general no .
party shall be liable to another party for personal injury or property a
damage unless such injury or damage is caused by the fault, negligence, or intent of the one party or its agents.

l I SECURITY PLAN FOR THE ASSIGNMENT OF FOREIGN REGULATORY AGENCY EMPLOYEE, EDILBERTO CABALFIN. TO THE NRC F
Purpose The purpose of this security plan is to specify and describe the procedure to be used to control and prevent access by Mr. Cabalfin to classified and other .
sensitive information.
Background
Mr. Ma is on a six-month assignment from the Philippine Atomic Energy V Commission to the United States Nuclear Regulatory Commission. This six-month period is from about May 1980 through November 1981. He has been assigned to the Radiological Impact Section, Radiological Assessment Branch (RAB). Division of Site Safety & Environmental Analysis. During this assignment Mr. Cabalfin will perform the functions of a radiological specialist which includes the i review of individual and population impacts associated with the release of radionuclides from nuclear power facilities. He may work with other branches in NRR for short periods of orientation. Mr. Cabalfin's direct supervisor is Dr. Frank J. Congel, Leader, Radio ogical Impact Section, RAB. {
Protection of Information RAB does not retain, or store, any classified or sensitive information. Thus, in the normal course of Mr. Cabalfin's activities, he will not be exposed to
, any such information.' Classified or sensitive information held in other parts of the division or office to which Mr. Cabalfin is assigned will be protected through normal procedures requiring a need-to-know prior to access. Prior to any short periods of work with other branches by Mr. Cabalfin, F. J. Congel will inform the other branches of the content of this plan to insure that classified and sensitive information is not accessible.
It has been determined that Mr. Cabalfin can adequately perfonn his assigned functions without having access to proprietary infonnation. Proprietary infor-mation is maintained in RAB. Mr. Cabalfin and all staff members of RAB have been instructed by F. J. Congel, that Mr. Cabalfin does not have a need to use proprietary information. An agreement signed by Mr. Cabalfin concerning the use of proprietary information is attached to this plan.
Badging and Escorting
- Mr. Cabalfin will be issued a special photo identification badge which will allow unescorted access to and within the Phillips Building, (11 story structure only, library and cafeteria) except designated security areas as defined in NRC Security Manual Chapter 2101, or areas in which classified information or sensitive unclassified matter is processed. 2 on this plan, Mr. Cabalfin acknowledges the requirement to wear this badge in a visible location at all times while inside NRC buildings. All Office of Nuclear Reactor Regulation personnel and particularly those assigned to o PSB, have been informed by Dr. Congel of the requirenent for Mr. Cabalfin to wear his badge.
Mr. Cabalfin will be escorted whenever it is necessary for him to visit other offices within the Phillips Building, outside the above mentioned areas, or when he has need to visit other NRC Buildings.
Work Area Mr. Cabalfin's normal work area is that of RAB, Phillips Building, Rooms on the 5th, 6th, and 7th floors . There is no classified or sensitive unclassified (e.g., nuclear propulsion or fuel cycle) information located in Rooms identified earlier in this paragraph. Proprietary information i
maintained by RAB is normally stored inside desks or file cabinets.
- Visits by Others to NRC Facilities By signature on this plan, Mr. Cabalfin acknowledges the requirement that he may not authorize visits by other individuals to NRC facilities.
Imolementation This plan has been agreed to by Dr. Congel and representatives of IP and SEC. Dr. Congel is responsible for the direct implementation and conduct of this plan. IP and SEC are responsible for informing other~ NRC personnel' about the program for assignment of foreign regulatory agency employees to the NRC and the related responsibilities about protection of certain infarmation.
Any modification or change to this Security Plan, such as temporary reassignment or training within another building, will be approved by the Division of Security prior to implementation.
