& Pages This document is not to be reproduced without specifia APPENDIX A approval of II:II NOTICE OF VIOLATION General Electric Company Docket No. 70-1113 Wilmington Manufacturing Department License No. SNM-1097 As a-result of'the inspection conducted on September 20-23, 1983, and in accord-ance with the' NRC Enforcement Policy, 47 FR 9987 (March 9,1982), the following violations were identified.

A. License Condition 2.1 requires the licensee to follow the current revision of his Fundamental Nuclear Material Control Plan. Section 4.5.1 of that plan requires the licensee to reevaluate control chart limits at least once each material balance period. 10 CFR 70.57(b)(10) requires the licensee to evaluate with appropriate statistical methods all program data and information used to establish parameters pertaining to special nuclear materials control and accounting. 10 CFR 70.51(c) requires the licensee to establish written material control and accounting procedures.

Contrary to the above, during the material balance period of August 10, 1982 through August 8,1983, the licensee did not properly evaluate the control chart limits associated with the NBL 97 standard (used to monitor uranium concentration measurements of uranium dioxide powder) in that current measurement data was not compared, by means of statistical tests, with the measurcmsnt data upon which the control chart limits were based. Also, the licensee did not establish a written procedure to describe the methods and criteria to be used for evaluating the applicability of current control chart limits.

This is a Severity Level IV Violation (Supplement III).

B. 10 CFR 70.57(b)(5) requires the licensee to review and approve, before use, written procedures for analyzing program data and controlling measurement performance. In addition, 70.57(b)(10) requires the licensee to evaluate with appropriate statistical methods all program data and information used to establish parameters pertaining to special nuclear materials control and accounting.

Contrary to the above, the licensee reviewed and approved Procedure COI

  1. 002, dated May 6, 1983, which describes the methods used to calculate control chart limits for controlling measurement performance, and failed to detect that the procedure contained the use of inappropriate statistical techniques. The subsequent use of this procedure caused the licensee to control measurement performance at a level which was inconsistent with the requirements of 10 CFR 70.57(b)(11).

This is a Severity Level IV Violation (Supplement III).'

Consideration may be given to extending your response time for good cause shown.
