NOTICE OF VIOLATION ,

Wilmin ton Nuclear Fuel Manufacturing Facility

. License No. SNM-1097  !

i During the Nuclear Regulatory Comission (NRC) inspection conducted on  ;

September 26-30, 1988, a violation of NRC requirements was identified. In accordance with the "General Statement of Policy and Procedure for NR* t Enforcement Actions " 10 CFR Part 2, Appendix C (1988), the violation is listed i below- l 10 CFR 70.59(a) requires that a licensee authorized to possess and use f special nuclear material for processing and fuel fabrication, scrap  !

recovery or conversion of uranium nextfluoride shall submit a report to  !

the appropriate NRC regional office within 60 days af ter January I and  !

July 1 of each year specifying the quantity of each of the principal l radionuclides released to unrestricted areas in liquid and gaseous ,

effluents during the previous six months of operation. l 6

Contr$ry to the above, the licensee did not submit the semiannual effluent  :

report *mr the period January through June 1988 untti fep.omber 27, 1988. [

This is a Severity Level Y violation (Supplement IV).

i Failure of the licensee to submit a semiannual report within the proper time ,

period was identifie6 as a violation of 10 CFR 70.59(a). It is the policy of i the NRC to cite but not require a response to a Notice of Violatinn for '

violations of minor safety or environmental concern identified by the inspsetor and for which, by the end of the inspection, the licensee had already I taken or was in the process of taking adequate corrective actions to prevent recurrence. Pursuant to this policy, it was detei.ntned that the event discussed above met these criteria and no respense would be required to the violation of 10 CFR 70.59(a) (70-113/88-17-01).  ;
