Trojan Nuclear Plant Document Control Desk Docket 50-344 January 27,1993 License NPF-1 Attachment 1 Page1of5 Hackcround and Reason for Chance The Trojan Nuclear Plant (TNP) Facility Operating License, NPF-1, currently allows Portland General Electric (PGE) to possess, use, and operate the facility in accordance with the license. This requested license amendment proposes to modify the Trojan operating license to a " Possession Only License" (POL). The POL will allow Trojan to possess special nuclear material but not to operate the nuclear reactor. In addition, the POL will provide the licensing basis for the Nuclear Regulatory Commission to grant regulatory relief to PGE from certain operational requirements that are inappropriate for a permanently shutdown and defueled reactor. This license modification is being requested to support the 6 cision by PGE to permanently cease power operation at the Trojan plant. Description of Chance The requested amendment to the Trojan Facility Operating License deletes references to use of special nuclear material as reactor fuel and removes on a permanent basis authorization to operate the facility as a nuclear generating station at any power level. Beyond the changes to the Facility Operating License noted above, additional changes were made in Section 2C not in support of the POL, but to delete historical information or items that are no longer applicable to Trojan. The items deleted included Section 2C(3),

                                 "Less than Four Loop Operation" (no longer applicable), Section 2C(4), " Report on Vibtation Tests" (historical information), and Section 2C(5), " Replacement of Certain Relays" (no longer applicable) In addition, selected items from Section 2C(6), " Spent Fuel Pool Modification" (no longer applicable), were deleted The items deleted in this section pertained to spent fuel storage requirements prior to commencing work on the modined rack design performed in accordance with submittals in August and October 1983. Additionally, a portion of Section 2C(7), " Quality Assurance", was deleted. The deleted text pertained to the Quality Assurance Program for Construction requirements for the installation of certain hangers, restraints and snubbers and was considered no longer applicable to Trojan The changes to Section 2C are considered editorialin nature.

Similarly, items in Enclosure 1 to License NPF-1, " incomplete Preoperational Tests, Startup Tests and Other Items Which Must be Completed", have been deleted as these items are no longer considered relevant to Trojan's permanently shutdown and defueled condition. This enclosure identined certain preoperational tests, startup tests and other items that had to be completed to the satisfaction of the Commission prior to achieving certain specified operating conditions These deletions from Enclosure I to the Trejan Facility Operating License are considered editorial in nature. _-mm --

Page 2 of 5 No Sienificant linrards Considerations Determination Description of the Ameruhnent Request This requested amendment modifies Facility Operating I,icense NPF-1 for the Trojan Nuclear Plant (TNP) to a " Possession Only License" (POL) The requested amendment will allow Portland General Electric (PGE) to possess special nuclear material but will-remove authorization to operate the nuclear reactor at any power level permanently. The change is requested to take efTect immediately upon NRC approval of this amendment and certification from PGE, by letter, that the fuel has been oft-loaded from the reactor core and stored in the spent fuel pool. The following discussion will demonstrate that the requested license amendment involves no significant hazards considerations. t No Sigmficant fla:ards Considerations Determination In accordance with the three factor test of 10 CFR 50.92(c), implementation of the requested license amendment is analyzed using the following standards and found not to:

1) involve a signincant increase in the probability or consequences of an accident previously evaluated, or 2) create the possibility of a new or di!Terent kind of accident from any accident previously evaluated; or 3) involve a signi0 cant reduction in a margin of safety.

Conformance of the requested amendment to the standards for a determination of no signincant hazards as defmed in 10 CFR 50.92 is shown in the following:

1) 1he requested license amendment does not involve a significant increase in the probability or consequences of an accident previously evaluated.

The requested amendment will remove on a permanent basis PGE's authorization to operate the Trojan Nuclear Plant as a nuclear electrical generating station. The requested amendment does not modify the present plant systems or administrative controls necessary to' preserve and protect the integrity of the nuclear fuel on site at Trojan. The requested amendment will not increase the probability of occurrence of previously evaluated accidents. With the reactor permanently shutdown and defueled, a number of previously evaluated accident are no lop r credible and thus the probability of their occurrence is reduced. The revested amendment l in no way increases the probability of occurrence of fuel handling r:cidents previously evaluated, and these analyses remain valid. These analyses address the consequences of an accident while fuel is in the spent fuel pool, in the reactor vessel, or in transit during core off-load.

Therefore,  ; the requested change does not involve a significant increase in the probability or consequences of an accident previously evaluated. 1 The historical information and information no longer considered relevant deleted from Section 2C and Enclosure 1 of the Facility Operating License _ are considered editorial changes and do not affect the manner in which systems or components are operated or maintained. These changes do not alter the intent of the Facility Operating License and , therefore, do not - involve a significant increase in the probability or consequences of an accident previously evaluated.

2) The requested license amendment does not create the possibility of a new or d t(ferent kind ofaccidentfrom any accident previously evaluated.

Upon permanent shutdown and defueling under the requested amendment, PGE's authorization to resume power operation is removed on a permanent basis. Any accident associated with this requested change is bounded by current accident analyses.- Existing analyses address potential accident scenarios from shutdown conditions through full power operation; There are no new accident scenarios or failure modes created by maintaining the reactor in the defueled condition. In the permanently shutdown, defueled condition with the fuel stored in the spent fuel pool, there are no new credible accident conditions that difTer from those previously analyzed Therefore, the requested change ivill not create the possibility _ of a new or different kind of accident. The historical information and information no longer considered relevant deleted from Section 2C and Enclosure 1 of the Facility Operating License - are considered editorial changes and do not afTect the m'anner in which systems or components are operated or maintained. These editorial changes do not alter the intent of the Facility Operating License and, therefore, do not create the possibility of a new or different kind of-accident from any accidnt previously evaluated. .

The requested amendment removes on a permanent basis PGE's - authorization to operate the Trojan Nuclear Plant as a nuclear electrical generating station. Defueling the reactor and placing the fuel in the spent fuel pool does not adversely impact previously accepted _ margins of safety. Therefore, the requested change does not involve a sipificant reduction in a margin of safety. The historical information an? % formation no longer considered relevant deleted from Section 2C and r...c.osure 1 of the Facility Operating License are considered editorial changes and do not afTect the manner in which systems or components are operated or maintained. These editorial changes do not alter the intent of the Facility Operating License and, therefore, do not involve a significant reduction in a margin of safety. On the basis of the preceding analysis, it is concluded that the amendment of Trojan Facility Operating License NPF-1 to a Possession Only License is acceptable and involves no significant hazards considerations as defined in 10 CFR 50.92. Fnvironmental Impact Considerations Determination This amendment request meets the criteria specified in 10 CFR 51.22 (c)(9) for categorical exclusion or otherwise not requiring environmental review. Specific criteria contained in this section are discussed below. (i) 1he amendment invoh es no signtlicimt ha:ards considerations. As demonstrated above, this requested amendment does not involve any significant hazards considerations. (ii) There is no significant change in the types or significant increase in the utnounts of any effluents that snay be released offsite. The requested license amendment proposes to mod 4, the Trojan Facility Operating License to reflect the permanently defueHd and shutdown

condition of the Trojan Nuclear Plant and does not involve changes to any _

plant systems or components. The POL in itself will not authorize additional plant activities beyond those that may already be conducted in support of the current operating license. Administrative controls on plant

Moreover, there are no . new accident scenarios or failure modes created by maintaining the reactor

                  - in the defueled condition. Thus, because the requested amendment involves no changes to plant systems, components, or administrative controls, and as no new accident scenarios or failure modes are created, no             l anticipated plant activities as a result of the issuance of this requested amendment should result in a significant change in the types or significant increase in the amounts of any efiluents that may be released offsite.

(iii) there is no sigmficant increase in individual or cumulative occupational radiation exposure. 't The issuance of a POL for Trojan will not authorize additional plant activities beyond those that may be conducted in support of the current operating license. The requested POL will provide the licensing basis for the Nuclear Regulatory __ Commission to grant future regulatory relief to PGE from certain operational - requirements that are inappropriate for a permanently shutdown and defueled reactor. These operational requirements (surveillance testing, inspections, etc.), in some cases, result in the accrual of occupational radution exposure for Trojan workers. As the requirements for conducting these activities are reduced, many of these activities may be eliminated. The elimination of these unnecessary activities is expected to result in a decrease in the cumulative occupational radia_ tion exposure, as compared to the exposure associated with maintaining the current operating license authorizing continued power operation.. In addition, administrative controls shall remain in place t_o ensure that individual occupational - radiation exposure is maintained below applicable regulatory requirements. On the basis of the preceding discussion, it is concluded that amending License NPF-1 to a Possession Only License is acceptable and meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9), and thus no environmentalimpact statement or environmental assessment need be prepared in connection with the issuance of this

1. The Nuclear Regulatory Commktion (the Commksion) having found that:

A. The appilcation for license filed by Portland General Electric Cornpany, the . City of Eugene, Oregon, acting by and through the Eugene Water and Electric Board, and Pacific Power and Light Company' (the licensees) complies with the standards and requirements of the Atomic Energy Act.of 1954, as amended (the Act), and the Commission's rules and regulations set forth in 10 CFR Chapter I and all required notifications to other agencies or bodies have been duly made; B. Construction of the Trojan Nuclear Plant (facility) has been substantially completed in conformity with Constmetion- Permit No. CPPR-79 and the application, as amended, the provisions of the Act and the rules and regulations of the Commiss 6 __mainta g , C. The facility c;fetzte in contornuty with the application, as amended, the l provisions of the Act, and the rules and regulations of the Commission; D. There is reasonable assurance: (i) that the activities authorized by this operating license can be conducted without endangering the health and safety 'l of the public, and (ii) that such activities will be conducted in compliance with the rules and regulations of the Commission; E. Portland General Electric Company is technically qualified and' the licensees are financially qualified to engage in the activities authorized by this cp= ting l license in accordance with the rules and regulations of the Commissions;

                 " Pacific Power and Light Company, which has a 2.5% ownership interest in Trojan, has merged with Utah Power and Light Company to become a new corporation-named PC/UP&L Merging Corporation, which will change its name to PacifiCorp, but will operate under the assumed business name of Pacific Power and Light Company.

A. This license applies to the Trojan Nuclear Plant, a pressurized water nuclear reactor and associated equipment (the facility) owned by the licensees. The facility is located on Portland General Electric Company's site on the we t shore of the Columbia River in Columbia County, Oregon, and is describel in the Updated Final Safety Analysis Report, as supplemented and amended in accordance with 10 CFR 50.71(e), and the Environmental Report as supplemented and amended (Supplements 1 through 3). B. Constmetiori of the Trojan Nuclear Plant (facility) has been substantially completed in conformity with Construction Permit No. CPPR-79 and the application, as amended, the provisions of the Act and the mles and regulations of the Commission; C. The facility it located on Portland General Electric Company's site on the west shore of the Columbia River in Columbia County, Oregon, and is described in the Updated - Final Safety Analysis Report, as supplemented and amended in accordance with 10 CFR 50.71(c), and the Environmental Report as supplemented and amended (Supplements 1 through 3). B. Subject to the conditions and requirements incorporated herein, the Commission hereby licenses: (1) Pursuant to Section 103 of the Act and 10 CFR Part 50, " Licensing of Production and Utilization Facilities," to possess, use, but not operate the . fac.ility at the designated location in Columbia County, Oregon in accordance with the procedures and limitations set forth in this license; I (2) Pursuant to the Act and 10 CFR Part 70, to possess at any time special nuclear material as reactor fuel, in accordance with the limitations for storage, described in the Final Safety Analysis Report, as supplemented and

The licensee shall fu;ly implement and maintain in efTect all provisions of the Commission approved physical security, guard training and qualification and safeguards contingency plans including amendments made pursuant to provision of the Miscellaneous Amendmente and Search Requirements to 10 CFR 73 55 (51 FR 27817 and 27822) and to the authority of 10 CFR 50.90 and 10 CFR 50.54(p). The plans, which contain Safeguards Information protected under 10 CFR 73.21, are entitled: " Trojan Nuclear Plant Security Plan", with revisions submitted through October 7,1988; " Trojan Nuclear Plant Security Force Training and Qualification Plan", with revisions submitted through June 10,1988: and " Trojan Nuclear Plant Safeguards Contingency Plan", with revisions submitted through October 7,1988. Changes made in accordance with 10 CFR 73.55 shall be implemented in accordance with the schedule set forth herein. E.
