Dear Mr. Itrbes :

This is in response to your letter of thrch 30, 1972.

As requested in your letter, the definition of an Agreement State as contained'in 10 CFR Rtrt 150 of AEC Regulations, copy enclosed, means "any State with which the~ Commission has entered into an effective agreement under subsection 274b. of the Act."

Part 150 describes the extent of the regulatory authority which is retained by the AEC pursuant to such an agreement. An agreement was entered into on December 9,1969, with the State of Georgia which provided for discontinuance by the AEC of certain regulatory authority within the State and assumption by the State of this regulatory authority. The agreement became effective on December 15, 1969, and a copy is enclosed Ibr your information.

Lhen the termination order for AEC Licence No. a-86 was issued by cur Division of Reactor Licensing on August 31, 1971, our regulatory l

authority over any nuclear activities at Lockheed Georgia's IArclear Imboratory, Dawsonville, Georgia, ceased except for those activities authorized under AEC byproduct autorial License No. lo-1425-14'and special nuclear mterini License No. SNM-260. These licenses were terminated on April 26. 1972, and Ity 4, 1972, respectively. The regulatory nuthority over the menining radioactive conta'minants was assumed by the State of Georgia pursuant to five licenses issued hv Georgin on August 31, 1971. 'Ihus, the AEC now has no authority ever any activitics at this~ facility ano any regu.Latory aGthority rennrding the une or release of the acuuy is solely within the jurisdiction of the State or coornaa.
